Hidayatullah.com and the Citizen Daily reported a controversial statement from Raihan Diani - an activist and former chairwoman of the Democratic Aceh Women Organization (ORPAD) in a discussion in Jakarta, January 16. Diani accused the enforced Sharia law in Aceh often resulted in discrimination against Acehnese women. This accusation was conveyed in a discussion forum entitled "Sharia and Women Prosperity in Aceh" which took place in Bakoel Café, Cikini Jakarta. Diani also stressed that "Aceh Sharia law is not prospering Aceh people, many people traps in vigilantism in the name of Sharia". In December 2014, BNP2TKI - a national workforce's agency indeed recorded high rates of poverty in Aceh approximately 17 per cent, above the average national rate of 11 percent. The number of unemployed in August 2014 amounted to 191 thousand, an increase of about 44 thousand people compared to the state in February 2014.
Comment:
Raihan Diani may not understand or pretending not understands that the implementation of Sharia in Aceh is not an ideal application. It was born as a pragmatic political compromise between the secular regime Indonesia and Aceh Independent Movement (GAM) as local political entity; they both agreed to dwarf Islamic Sharia partially and locally in Aceh. Secondly, Raihan Diani seems doesn't have clear understanding on Islamic Sharia, since she put human rights and freedoms as an evaluator on Islamic laws, just exactly like the cynical secularists against Islam to seek sympathy from the West.
Diani and all the women activists who adore human rights and freedom need to know that the root of complications and dilemmas arising from the Sharia implementation in Aceh is PRECISELY originated from the subordination of the Sharia law into the secular laws, such as human rights and democracy. Therefore, Islamic Sharia is dwarfed only to be local and partial, and subjugated to the man-made laws including the Capitalist economic system that continues to fuel poverty and economic inequality within thousands women in Aceh.
The Sharia has been deliberately designed NOT to interfere economic liberalization and foreign investment in Aceh. The Sharia also purposely left implemented by local incompetent regime who always become the butt of foreign media. The Sharia also intentionally left implemented without full education and socialization into Acehnese society so they cannot correct their ruler with regards the ideal implementation. The Sharia also dwarfed only in criminal aspect with poor political vision - which caused injustice complications in the society. Ironic! The failure of Sharia partial application in Aceh has become an easy target for the enemies of Islam. Sort provides endless ammunition for them to point the finger at Islam as it's unable to solve various problems.
The Islamic system can only be assessed objectively if in fully and holistically implemented, because the application of Islamic law partially, will not solve the overall problems. The history of Aceh alone has spoken. The land of Aceh and throughout the Archipelago, Islamic Sharia has once implemented comprehensively for nearly 10 centuries under the Islamic Caliphate - with no subordination by foreign powers and man-made laws as in the case today. The women of Aceh had experienced for many centuries how Islamic law dignified them, raised their public roles, and secured their honors. Therefore, great names of Aceh Muslim Women like Laksamana Hayati and Cut Nyak Dien were only few examples of the many Muslim woman figures that had major roles in the community, absolutely away from the image of being unfettered and discriminated as often narrated by the Western media. In the Islamic era, it's also barely audible about the practice of exploitation or forced labor of women. In stark contrast with nowadays where millions of women who are deprived of their economic rights due to mass impoverishment done by the secular capitalist economic system, including Aceh women.
The political vision of Islam consists of a single leadership for Muslims around the world namely the Khilafah "Caliphate" Islamiyah, which will establish a sincere Khaleefah who will lift their economic burdens from their backs and place it upon his shoulders. The Islamic Khilafah "Caliphate" system alone offers sound economic policies that have stood the test of time and are able to lift the women in the Muslim world from the pain of poverty and create sustainable economic welfare, hence removing their suffering and bringing real change to their lives. This political vision will not be real when the application of Sharia is only partially, locally and gradually performed as Sharia local regulations in Aceh, Brunei, or Saudi Arabia. Besides that, it should be understood that taking a part of Islamic law and abandoning the rest is a great sin. Allah (swt) says:
أَفَتُؤْمِنُونَ بِبَعْضِ ٱلْكِتَٰبِ وَتَكْفُرُونَ بِبَعْضٍۢ ۚ فَمَا جَزَآءُ مَن يَفْعَلُ ذَٰلِكَ مِنكُمْ إِلَّا خِزْىٌۭ فِى ٱلْحَيَوٰةِ ٱلدُّنْيَا ۖ وَيَوْمَ ٱلْقِيَٰمَةِ يُرَدُّونَ إِلَىٰٓ أَشَدِّ ٱلْعَذَابِ ۗ وَمَا ٱللَّهُ بِغَٰفِلٍ عَمَّا تَعْمَلُونَ
"Then is it only a part of the scripture that you believe in, and reject the other? What then is the reward of him who does this among you except disgrace in the life of this world? And on the day of the Awakening they will be sent back to the most severe chastisement. And Allah is not unaware of what you do." [Al Baqarah: 85]

A dark cloud of Islamophobia covers the skies of Europe these days, resulting in cowardly attacks on Muslim, from the burning of mosques in Sweden, assault of Muslim women in the Netherlands and another in Belgium and numerous attacks on the Muslims of France, where these attacks exceeded more than 50 cases in a few days, not to mention the hashtag (#KillAllMuslims), which has become the most widely used through the social media.
It is naive to think that these events are individual acts of perverted people and outlaws or affiliated to the fanatic right-wing. A closer follow-up of the reality show that political and cultural elites in the West are the ones that nourish and adopt an atmosphere of Islamophobia. These elites through its deception have turned the attack on the satirical magazine into a declaration of war on the Western world and its values. At the same time, these elites ignore the successive series of attacks on Muslims and their mosques and sanctities; and refuse to describe them as acts of terrorism or a declaration of war on Islam and its values.
The Danish Justice Minister has stepped up the pace of the attack, when she said, "The enemy we face has declared war on us ..." She added, "When I say (we) I mean everyone in the world who does not believe in the Caliphate (state)." It is true that Western politicians are narrow-minded when it comes to understanding the culture of non-Western civilization, but the minister is fully aware that the concept of the Khilafah "Caliphate" was brought by the Prophet (saw) and it is the system of government and structure of society in Islam. So, therefore her statement emboldens of Islamophobia and feeds hatred and polarization in society. He (swt) says:
((وَلاَ يَزَالُونَ يُقَاتِلُونَكُمْ حَتَّىَ يَرُدُّوكُمْ عَن دِينِكُمْ إِنِ اسْتَطَاعُو ا))
"And they will continue to fight you until they turn you back from your religion if they are able" [Al-Baqara: 217]
She then added, "... we are forced to give the intelligence agencies and police powers that were not already in their hands, because we must face the dark entities that operate in the arena." End of quote.
The reaction of Western politicians at the wake of Charlie Hebdo events is full of fallacies, double standards, and escalation against Muslims, which is a clear evidence of the weakness of Western values. These politicians have been portraying a security incident (the attack on Charlie Hebdo) as a civilized attack that threatens the civilization of the West and its values and foundations. While those who are wise know that the foundation of societies are not threatened by the death of seventeen people, but the foundations of society either stand firm or collapse depending on the strength, sincerity, and humanity in those foundations. The irony is that the politicians who boast that the foundations of their societies are based on humanity, democracy, freedom and human rights, are themselves who pass laws that allow criminalizing and silencing dissent, and give intelligence agencies broad powers to monitor citizens and spy on them, under the pretext of fighting terrorism, and by this they themselves who demolish their ideological basis which they claim that it is founded on freedom and human rights. What objectivity and any humanity do these countries claim, when they make the insulting and humiliating of others a vital issue for which provoke their people.
Islam and its people are mocked, which constitute more than one and a half billion in number while Charlie Hebdo journalists and other worthless people are described as heroes and praise for their actions and given honors and awards for the sake of freedom of expression, and at the same time, Muslims are demanded to show absolute loyalty to Western values that sanctify freedoms.
Freedom of expression is a failed idea that has no foundation, but it is a political tool used by those in power in the face of their opponents. Examples of this are many and countless; for example, in Denmark, the Danish public institutions, as they have announced that work that they are fighting against Shariah law by reducing the number of people who are convinced of it and is working to increase the number of those who are opposed to it. As well as what France did last year to prevent peaceful demonstrations in support of Palestine, arguing that they undermine public security in France.
O Muslims: Islam commands us to address the non-Muslims in the best manner, but this does not mean the acceptance of insulting Islam and the Prophet (saw), this is a great matter that necessitates the appropriate response and this can only happen through the authority of Islam represented by the Khilafah "Caliphate", which will carry out legal, diplomatic, economic, and military sanctions against the country or countries that are offensive to the sanctities of Muslims.
O Muslims: It is not permissible to bury our heads in the sand and accept that Islam is accused, but we should be proud of our loyalty to Islam, it is the true Deen, which is liberation for all people. Those who are asking us to declare our condemnation are themselves who commit the worst crimes against humanity. There are the ones who kill unarmed and innocent civilians in all parts of the Islamic world, from Afghanistan, Pakistan to Somalia and Yemen, and from Burma and China to Iraq and Palestine. Here is Syria - a current witness to the West's support for the crimes of its tyrant, whose crimes affected more than half a million people.
So we, O Muslims, must uphold the Islamic values and maintain our identity in the face of pressures and dangers which threaten it here in the West, we do not need the fake freedom of expression they want to impose on us.
O Muslims: We are positive, and we want the world to know, that speaking and the expression with the truth and by it is an obligation on us, we will carry it out and adhere to it whatever the consequences. Our pure Deen prevents us from mocking and insulting people and it even ask us to reveal the false misleading ideas, such as freedom of expression, and it commands us to be loyal to Allah, His Messenger, and the believers.
Allah (swt) says:
((وَلاَ تَهِنُوا وَلاَ تَحْزَنُوا وَأَنتُمُ الأَعْلَوْنَ إِن كُنتُم مُّؤْمِنِينَ ))
"So do not weaken and do not grieve, and you will be superior if you are [true] believers" [Al-i-Imran: 139]
Hizb ut Tahrir / Indonesia organized a massive demonstration in front of the French embassy in Jakarta, which strongly condemned the satirical magazine Charlie Hebdo that published cartoons depicting the Prophet Muhammad, peace be upon him and his family. During a meeting with a delegation of the party representative of the French Embassy, the delegation expressed its condemnation of the French government, which allows for insulting the Prophet Muhammad (peace be upon him). The delegation also stressed that the so-called freedom that gave way to these crimes against the Ummah of Islam is pure nonsense. The demonstrators were protesting outside the embassy carried banners with slogans and phrases to support and defend the Prophet of Allah peace be upon him including "The Khilafah "Caliphate" will stop the abuse against the Prophet of Allah, peace be upon him."
At the same level Hizb ut Tahrir / Indonesia held similar marches to defend the Messenger of Allah, peace be upon him, in major cities across Indonesia, in Surabaya, Makassar, Bandung, Medan, Lampung, and other major cities.

On 7 January 2015, the President of Pakistan signed the 21st Amendment Bill into law, passed by the Parliament, which gives sweeping powers to the government to establish military courts to try suspects in terrorism cases. Prime Minister, Nawaz Sharif, said the "21st Constitutional Amendment would lead to quick dispensation of justice and will help the country in eliminating the menace of terrorism." The process of the establishment of the military courts has been initiated after the approval of the 21st Amendment in the Constitution and the Army Act Amendment. According to the Inter Services Public Relations (ISPR), at least nine military courts would be established in the first phase of the process. (Source: Tribune, 06/01/2015)

After the deadly attack on an Army Public School in Peshawar on 16 December 2014, in which 141 people were killed, most of them children; the Raheel-Nawaz government quickly moved to try to turn public opinion and called two all-party conferences to further the so-called US War on Terror. It sped through the formation of the National Action Plan consisting of twenty points. The crux of this document was the establishment of military courts for two years, to try terror suspects, as wells as steps against religious incitement, registration and regulation of religious educational institutes (Madaris). Based on this document, the 21st Amendment Bill was introduced.
The National Action Plan and the 21st Amendment are clearly aimed at eradicating the concept of Jihad against the Kuffar occupying forces. Moreover, not only is the regime now persecuting the sincere mujahideeen who only target the Western crusaders, the regime is also persecuting those who demand the implementation of Islam by political and intellectual struggle in the country. In this amendment, it is stated that "the provision of Article 175 shall have no application to the trial of a person.... belonging to any terrorist group or organization using the name of religion or a sect." Through this, the Raheel-Nawaz regime has ensured that Islam loving people will be tried by military courts. Even if they had not specifically mentioned this discrimination, it was obvious from the statements of the traitors in the ruling leadership that the blood of dozens of innocent children will be exploited to further the US plan in Pakistan. The regime is chasing each and every person who, despite the announcement of military courts, dares to speak against the American Raj in Pakistan and demands the implementation of Islam.
Almost thirty-five years ago, the US encouraged the rulers of Pakistan to spread the teachings of Islam, specially Jihad, because it wanted to counter the Soviet occupation of Afghanistan. America knew that Muslims will only move and fight against USSR for the sake of Islam. However, when after 9/11, America itself occupied Afghanistan and the Muslims of the region again took arms against it, as their Islamic duty to wage Jihad against intruding crusading armies, America demanded traitors in the political and military leadership to rollback that policy. With the support of traitors in Pakistan's leadership, America thought it would succeed in suppressing Islam.
However, the Muslims of Pakistan are strongly attached to Islam and consider it as their cause. Thus, this National Action Plan, which in reality is an American action plan, will fail in trying to force the Muslims of Pakistan to abandon their aspirations to make this country a true Islamic state. The people of Pakistan are the sons and daughters of that generation who fought against British Raj, an empire larger than the current US empire. Despite occupation, they overwhelmed the colonialists and forced the British to leave the Indian Subcontinent. InshaAllah now when the desire for Islamic ruling has entered every house in this country, as well as the ranks of the armed forces', this US plan is destined to fail. And the day when the Khilafah "Caliphate" returns, which is not long now, the crusaders and their agents in the Muslims Lands will bite their fingers and hands with their own teeth, cursing themselves for their wasted efforts. Allah (swt) said,
إِنَّ ٱلَّذِينَ كَفَرُواْ يُنفِقُونَ أَمْوَالَهُمْ لِيَصُدُّواْ عَن سَبِيلِ ٱللَّهِ فَسَيُنفِقُونَهَا ثُمَّ تَكُونُ عَلَيْهِمْ حَسْرَةً ثُمَّ يُغْلَبُونَ وَٱلَّذِينَ كَفَرُوۤاْ إِلَىٰ جَهَنَّمَ يُحْشَرُونَ * لِيَمِيزَ ٱللَّهُ ٱلْخَبِيثَ مِنَ ٱلطَّيِّبِ وَيَجْعَلَ ٱلْخَبِيثَ بَعْضَهُ عَلَىٰ بَعْضٍ فَيَرْكُمَهُ جَمِيعاً فَيَجْعَلَهُ فِى جَهَنَّمَ أُوْلَـٰئِكَ هُمُ ٱلْخَاسِرُونَ
"Verily, those who disbelieve spend their wealth to hinder (men) from the Path of Allah, and so will they continue to spend it; but in the end it will become an anguish for them. Then they will be overcome. And those who disbelieve will be gathered unto Hell. In order that Allah may distinguish the wicked (disbelievers, polytheists and doers of evil deeds) from the good (believers of Islamic Monotheism and doers of righteous deeds), and put the wicked (disbelievers, polytheists and doers of evil deeds) one on another, heap them together and cast them into Hell. Those! it is they who are the losers." [Al-Anfal: 36-37]

In May 2014, Narendra Modi's Hindu nationalist government of BJP secured India's biggest election victory since 1984. He is a controversial figure for Muslims as his 13-year tenure as Chief Minister of Gujarat state saw the worst communal riots in which hundreds of Muslims were killed.
Modi has also been a lifelong member of the RSS. The Rashtriya Swayamsevak Sangh (RSS), the parent outfit of male only Hindu nationalists, has long wanted India's religious minorities to call themselves Hindu. Members of the Bajrang Dal, a militant RSS affiliate, claimed this month to have "reconverted" 200 Muslims in Uttar Pradesh to Hinduism. Senior RSS ideologues hailed this "homecoming". These multiple reports of ‘forcible conversions' of Christians and Muslims to Hinduism, achieved apparently through methods ranging from offers of free food and education to outright threats of violence. The RSS, whose members fill 19 positions in Modi's cabinet, is also seeking to Hindu-ize India's Christian-majority northeastern states.
A senior minister in the Modi's cabinet claimed recently that ‘'there are two kinds of Indians: children of Lord Rama (Hindus) and bastards (Muslims and Christians)''. Though she was forced to disavow her comments, Modi criticised her mostly for distracting from his focus on development. Foreign Minister Sushma Swaraj has advocated that the Bhagavad Gita, the favourite text of upper-caste Hindus, should be declared the "national scripture" of India.
Rajnath Singh, the home minister, claimed recently that Werner Heisenberg (Nobel Prize winner in Physics) had derived his uncertainty principle from the ancient Vedas. Leaders of Modi's Bharatiya Janata Party now routinely propose revisions in modern science as well as history. According to some, bodily emanations of the holy cow - from milk to urine - can cure corruption as well as dysentery.
RSS as an organization believes in converting people from Hinduism to Hinduvta. It believes that Hinduism is a thought system perfect from its very origins, that all the problems of modernity and history were foreseen by Hindu sages 2,000 years ago, that all modern scientific achievement was prefigured in Hindu thought, that Indians of all faiths are "culturally Hindu", that India's four-fifths Hindu majority is under threat from minorities, and that all Hindus should fall in line with a singular interpretation of Hindu tradition controlled by a central authority. That body would be the RSS.
These views are just beginning to unfold from a very rich and corrupt ruling elite. Out of the 541 Lok sabha winners, 442 are Crorepatis - 237 belong to BJP. Also out of these 541 winners, 186 have criminal cases and 112 have ‘serious' criminal cases against them including cases related to murder, attempt to murder, disturbing communal harmony, kidnapping, and crimes against women.
The ‘uninterrupted' Indian democracy has miserably failed in protecting the rights of its minorities. In the run-up to this year's elections in India, tensions escalated between Hindu and Muslim communities. This led to a 30 percent increase in incidents of communal violence as compared to 2012. The central government's Ministry of Home Affairs reported 823 incidents of communal violence in 2013, in which 133 people died and over 2,000 were injured. One of the worst such incidents involved mass violence in September 2013 in Muzaffarnagar district in Uttar Pradesh, events in which at least 60 people died.
These incidents of violence against minorities are a direct outcome of the basic flaws within the Democratic system. As this system is based on the idea of attaining maximum financial benefit out of its population. The majority areas and majority population gets special attention and benefits from the ruling class, as re-election after every 4 or 5 years produces undue emphasis upon majority and neglect of the minorities.
Hence rulers favor the majority province over the minority province and majority population over minorities. For it is the votes of majority that gets them re-elected, so they put out all resources for development of majority areas and for the progress of majority population.
Although this situation of injustice and oppression is not limited to minorities, rather it spreads all over the society due to the tyranny of man-made system of Capitalism and democracy. However the minorities who face the brunt of this oppressive system are specially highlighted by the western media and human rights organization, while accusing the Islamic mindset and Islam for the crimes against minorities. In this process of Islam bashing, they forget however, that the system being implemented in Pakistan is not that of Islam, but is the secular capitalist system with its values of equalities, freedoms and social justice; which have failed to protect either minorities or majority not only in Pakistan but worldwide.
The Islamic system of Khilafah "Caliphate" is free of all these faults, as the Islamic ruling system is a unique system of unity ordained by Allah. It is not a federal, democratic, republican, monarchic or dictatorial system at all. It has no similarity to any man-made ideology. The Islamic state considers people under its authority as citizens, whether they are Muslims or non-Muslims. All have their rights guaranteed by Islam. There is no concept of 'ethnic minority' as people are not discriminated against at all for their color, race or religion. While the Khalifah has no fear of impeachment or vote of no confidence as long as he is ruling by Islam. The law making power belongs to Allah only. Khalifah or the members of Ummah Council have no legislating powers as Allah (swt) says:
((إن الحکم إلا للہ))
"Verily, Ruling is only for Allah" [Yusuf: 40]
Since man doesn't legislate in the Islamic system, hence it is not up to the Khalifah or the majority of the representatives to abrogate or suspend the rights of citizens, no matter which political group, ethnicity, religion or gender he belongs to. Hence the rights of the non-Muslim citizens are set in stone and nobody can change them. It was for this reason that the Christian citizens of the Khilafah "Caliphate" fought alongside Muslim armies against the Crusaders as they were happy and satisfied under Muslim just rule. Jewish communities in the Ottoman Empire held a protected status and continued to practice their own religion, as did Christians. Yitzhak Sarfati, born in Germany, became the Chief Rabbi of Edirne and wrote a letter inviting European Jews to settle in the Ottoman Empire, in which he asked: "Is it not better for you to live under Muslims than under Christians?''.
Sultan Beyazid issued a formal invitation to the Jews expelled from Catholic Spain and Portugal, leading to a wave of Jewish immigration. According to Michael Walzer (renowned political philosopher from Harvard):
‘'The established religion of the [Ottoman] empire was Islam, but three other religious communities-Greek Orthodox, Armenian Orthodox, and Jewish were permitted to form autonomous organizations. These three were equal among themselves, without regard to their relative numerical strength. They were subject to the same restrictions vis-à-vis Muslims-with regard to dress, proselytizing, and intermarriage, for example and were allowed the same legal control over their own members.''
The Prophet Muahammad (saww) said: "Whosoever persecuted a dhimmi (non-Muslim citizen), usurped his right or took work from him beyond his capacity or took something from him with evil intentions, I shall be a complainant against him on the Day of Judgement."
It is also reported, that Omar (ra) saw an old man begging from the people of Dhimmah so he said: "What is the matter?" The man said: "I have no money and the Jizya is taken from me". Omar (ra) replied: "We have not treated you fairly. We have eaten your shaybah (old age) and then we take Jizya from you." Umar then wrote to his governors instructing them not to take Jizya from the elderly.
Therefore, only Khilafah "Caliphate" Rashidah can save the lives, properties and honor of religious and ethnic minorities and create harmony and unity as it did for 1300 years in the past. Bukhara was thousands of miles away from the center of Khilafah "Caliphate" in Baghdad, but equally flourished and progressed under the glorious rule of Islam.
((يَا أَيُّهَا الَّذِينَ آمَنُوا لاَ تَتَّخِذُوا الَّذِينَ اتَّخَذُوا دِينَكُمْ هُزُوًا وَلَعِبًا مِنْ الَّذِينَ أُوتُوا الْكِتَابَ مِنْ قَبْلِكُمْ وَالْكُفَّارَ أَوْلِيَاءَ وَاتَّقُوا اللَّهَ إِنْ كُنتُمْ مُؤْمِنِينَ))
"O you who believe! Take not as Awliyaa' (protectors and helpers) those who take your religion as a mockery and fun from among those who received the Scripture (Jews and Christians) before you, and nor from among the disbelievers; and fear Allah if you indeed are true believers". [al-Maa'idah 5:57]
