Oh People! Demand from the Sincere Officers in the Military to Overthrow the Awami-BNP Ruling Regime for Establishing the Khilafah State under the Leadership of Hizb ut Tahrir And Mobilize on the Streets with this Demand

Bangladesh has become a land of death and destruction due to the Awami-BNP rule. The on-going political violence, chaos, strikes, police shootings and state terrorism is nothing other than fruits of the failed Awami-BNP politics. In the name of free and fair elections, democracy, or safeguarding the continuity of constitutional ruling and other cheap slogans, the Awami-BNP rulers have turned the country into a burial ground for the people. In other words, Awami-BNP rule = Death to the people. Furthermore all of the following hold true of Awami-BNP rule:

Awami-BNP rule = Corruption and looting

Awami-BNP rule = Majority of the population living in poverty

Awami-BNP rule = Oppression of women

Awami-BNP rule = Vilifying Islam and RasulAllah (saw)

Awami-BNP rule = Agent rulers serving U.S.-India

Etc. etc.

These are the fruits of over two decades of Awami-BNP rule and democracy. So why is there a big fuss about ensuring a so-called free and fair election? And what does it matter if Hasina and Khaleda or the Awami League and BNP hold a dialogue or not? And whether there is dialogue or not and whether there is an all-party participated election or one-sided election the results will be all the same. There will be no real change in people's lives. Real change will come only by uprooting the entire ruling regime. This requires the sincere military officers to take the side of the people, because the means for change is not in people's hands. The means are with the sincere officers, for they are the ones who have the material power to overthrow the regime. Thus overthrowing this regime is a duty on their neck but not for establishing military rule; rather they have to transfer the authority to the sincere and aware politicians to establish the Islamic rule - the Khilafah "Caliphate" state.

Hizb ut Tahrir therefore urges all sincere, aware and thinking people towards the following actions:

1. Reject the rule of Awami-BNP and their democratic system. Do not wait for their dialogue and their elections to once again vote and bring either of them to power.

2. Join with Hizb ut Tahrir in struggling against the current regime and working for establishing the Khilafah "Caliphate".

3. Demand from the sincere officers in the military to overthrow the Awami-BNP ruling regime for establishing the Khilafah "Caliphate" State under the leadership of Hizb ut Tahrir; and mobilize on the streets with this demand. Do not consider Awami-BNP's fight as just a confrontation which is between them. In fact it is a fight against you. And in this fight they are armed to the teeth with material power. You require material power too and that material power is to win the sincere officers to your side to aid you in removing the ruling regime.

And our call to the sincere officers in the military is as follows:

1. Fulfil your responsibility as Muslims. The duty to establish the Khilafah "Caliphate" is upon your neck as much as any other Muslim; in fact it is even more as you hold the key to authority i.e. the material power.

2. Fulfil your oaths which you took to serve the people and the country. How much longer will you be the protectors of Hasina and the ruling regime, how many more people have to die and how much more of our land has to face destruction before you respond to the Call of Allah (swt) and His Messenger (saw)?

3. Emulate the Sunnah of RasulAllah (saw) and be the Ansar for establishing the second Khilafah "Caliphate" State. With the help of the Ansar (ra), RasulAllah (saw) established the first Islamic state in Madina and that State continued until 1342 Hijri (1924 CE). If you become the Ansar for the second Islamic State, Allah (swt) will reward you in the same way as the first Ansar (ra), inshaAllah. Therefore overthrow the army officers' killer Sheikh Hasina's government immediately and transfer the authority to Hizb ut Tahrir for establishing the Khilafah "Caliphate". The Khilafah "Caliphate" will bring to justice the real conspirators and killers of the army officers unlike the show trials of BDR soldiers staged by Hasina.

((يَا أَيُّهَا الَّذِينَ آمَنُوا اسْتَجِيبُوا لِلَّهِ وَلِلرَّسُولِ إِذَا دَعَاكُمْ لِمَا يُحْيِيكُمْ))

"O you who believe! Answer the call of Allah and His Messenger when He calls you to that which gives you life..." [Surah Al-Anfal: 24]

Perth Now :: Hizb ut-Tahrir Australia conference hears 'this country at war' with radical Islam

  • Published in News & Comment

17/11/2013

A HARDLINE Islamic group has warned Muslims that the government was trying to "brainwash" their children and that they should resist any attempts to water down their strict view of Islam.

"The government is playing a dirty, dirty game," Wassim Doureihi told the 600-strong audience at the Hizb ut-Tahrir Australia conference in Lidcombe yesterday.

Hizb ut-Tahrir wants global sharia law. Yesterday in Sydney it launched a 124-page report on what it sees as Australian government attempts to divide the Muslim community into extremists and moderates.

"The fundamental objective of these policies is to change Islam, to secularise Islam, to produce a so-called 'moderate Islam': a state-sanctioned version of Islam that is secular, politically impotent and localised," it said.
Mr Doureihi warned the audience that it was "a war on Islam - a war that is being waged in this country as it is in the rest of the world".

Fellow speaker Soadad Doureihi warned: "This is truly a battle." He said the Australian government had "arrogantly" assumed that because Muslim youth "went to their schools and watch their TV shows" they would adopt "their values".

Because that did not happen, he said, authorities had instead moved to target young Muslims with sponsored leadership programs. "This is not a leadership course, it is a brainwashing course," he said.

Outside, about 20 Australian Defence League members waved banners and chanted: "Australians are welcome, terrorists are not" watched by police .

League president Ralph Cerminara said: "This (Hizb ut-Tahrir) is a terrorist organisation and it needs to be banned from Australia."

Inside people told how they had been approached by representatives of ASIO and the Australian Federal Police to inform on other members of their Muslim community.

"Know your rights," Wassim Doureihi said. "When ASIO calls the simple message is that you open the door and slam it on their face."

The organisers said the government was attempting to manipulate their community by providing funding via counter-terrorism and counter-extremism groups.

"Not only do you reject it, you spit on it because it is money that will be the source of your demise," Mr Doureihi said. "It's not engagement, it's entrapment."

Soadad Doureihi condemned the National Imam's Council and the Lakemba Muslim Association for taking government money that was "absolutely conditional" on producing a more watered down version of Islam.

Sheik Rian Wiramihardja said: "They are rewriting Islam to make it more palatable to Western tastes and we have to be aware of this."

The speakers called on those present to resist any attempts to moderate Islam.

Answer to the Question Regarding the Murabaha contract To: Muhammad Abdallah (Translated)

Question

Assalamu Alaikum Wa Rahamatullah Wa Barakaatuu

Our Sheikh and Ameer, Ata Bin Khalil Abu Al Rashtah, my question is: what is the ruling on the profit sales contract (Murabaha)? Is it permitted, fasid, or batil (invalid)? It so happened that some of our brothers made an agreement using the Murabaha contract -after some time - they realised that it is invalid. The first party who paid the capital, received the same amount of the capital plus a half (in profit), now after realising the prohibition of the contract, he is demanding the rest of the profit. The Question: What is the nature of the contract in terms of permission and prohibition? Is the money that he received permitted or prohibited? Does he have the right to demand the remaining profit after taking the amount of the capital and a half, even though the brothers know that the basis of action is that they must be restricted to the Shar' rules.
Please benefit us and Jazak Allah Kul Khair. Abu Suhail, Berlin

Answer

Wa Alaikum Assalam Wa Rahmatullah wa Barakaatuhu

What you called a Murabaha contract according to what came in your question where the owner of capital pays the money to another party for the purpose of trading with the money or deal with it and then gives him a guaranteed profit; this is not allowed in Islam.

What is permitted in Islam is when the owner of capital pays money to another party to trade with and they have an agreement upon a specific rate of profit share between them when there is a profit, and if there was no profit then both do not gain anything. If there is a loss the capital owner bears it as the other party who exerted his effort and traded would have lost his effort, i.e. it does not specify a guaranteed profit for the capital owner as we mentioned before.

This is what is called joint venture (Mudharaba).
A joint venture (Mudharaba) is one of the types of companies, because it is a company of money and body. The company is one of the transactions that Islam has permitted. On the authority of Abu Huraira that he said, that the Prophet (saw) said:إن الله يقول: أنا ثالث الشريكين، ما لم يخن أحدهما صاحبه، فإذا خانه خرجتُ من بينهما "Allah says: I am the third (party) of the two partners as long as one of them does not betray his partner, if he does then I abandon them" [Narrated by Abu Dawoud]

The Sahaba (ra) agreed that Mudharaba is permitted. Umar (ra) paid the money of the orphans by Mudharaba. This is mentioned in the Musanaf of Ibn Abu Sheeba.

Regarding the profit in Mudharaba, it is subject to the conditions depicted by both contracting parties.

As for loss, it is on the money. It was extracted by Abdul Razaq As-San'ani in his Musanaf from Ali (ra) regarding Mudharaba: الْوَضِيعَةُ عَلَى الْمَالِ، وَالرِّبْحُ عَلَى مَا اصْطَلَحُوا عَلَيْهِ "Loss is in money, and profit is based on what they agreed upon". Wadhee'a means loss.

For your information the term Murabaha in Shar' was mentioned in buying and selling contracts and not work contracts. Those who use Murabaha in work contracts between the capital owner and Mudharib, they use it out of its Shar'i place.

That is because Murabaha in the language means real profit, it is said: I sold the good by Murabaha or I bought Murabaha. In technical terms: for the seller to show the price he bought his products for sale and it should be for a known profit, it is from the Trust Sales because it relies on the trust of the seller in giving the information regarding what he paid for the product.

It is allowed in shar' because it is the buying with a profit on top of the cost price that the seller paid when he bought the product. If the seller says I will sell you this product with this much profit of the price that I bought the product for and the buyer is made aware of the price, and he accepts that, this is permitted because it is a known sale.

Your brother,
Ata Bin Khalil Abu Al-Rashtah
