Message of the Eminent Scholar Ata Bin Khalil Abu al-Rashtah regarding Ramadan 1434 AH

Bismillah ar-Rahman ar-Raheem

 

To the sincere brothers that carry the dawah....

To all the Muslims in all places of the world....

Assalamu Alaikum wa Rahmat Allahu wa Barakatu....

 

The Almighty says:

 

((يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الصِّيَامُ كَمَا كُتِبَ عَلَى الَّذِينَ مِنْ قَبْلِكُمْ لَعَلَّكُمْ تَتَّقُونَ))

 

"O you who have believed, decreed upon you is fasting as it was decreed upon those before you that you may become righteous."And the Glorified and Exalted says:

((فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْه))

 

"So whoever sights [the new moon of] the month, let him fast it."

 

And the Prophet, peace and blessings be upon him, says in what was reported by al-Bukhari narrated from Abu Huraira (ra):

 

«صُومُوا لِرُؤْيَتِهِ وَأَفْطِرُوا لِرُؤْيَتِهِ، فَإِنْ غُبِّيَ عَلَيْكُمْ فَأَكْمِلُوا عِدَّةَ شَعْبَانَ ثَلاَثِينَ»

 

"Fast when you see it, and break your fast when you see it, and if the weather is cloudy do calculate it (the months of Shaban and Shawwal) as thirty days."

 

And Muslim reported that Abu Huraira related, in another narration, that the Prophet (saw) said:

 

«صُومُوا لِرُؤْيَتِهِ وَأَفْطِرُوا لِرُؤْيَتِهِ، فَإِنْ غُمِّيَ عَلَيْكُمْ فَأَكْمِلُوا الْعَدَدَ»

 

"Observe fast on sighting it (the new moon) and break (fast) on sighting it (the new moon), but if the sky is cloudy for you, then complete the number (of thirty)."

 

After investigation and checking the moon of the Blessed month of Ramadan on this night, the night of Tuesday, no valid sighting of the New Moon of Ramadan has taken place according to the Shari'ah requirements, therefore, tomorrow Tuesday is the continuation for the month of Sha'ban InshaAllah, making the day after tomorrow, Wednesday, the first day of the blessed month of Ramadan in the year of 1434 AH corresponding 10/07/2013.

 

We ask the Almighty that he accepts the fasting and qiyyam of the Muslims and that Allah forgives us for what we have committed of sin, as the Prophet (saw) said in what al-Bukhari and Muslim reported that Abu Huraira narrated:

 

«مَنْ صَامَ رَمَضَانَ، إِيمَانًا وَاحْتِسَابًا، غُفِرَ لَهُ مَا تَقَدَّمَ مِنْ ذَنْبِهِ»

 

Allah's Prophet (saw) said: "Whoever fasts during Ramadan with faith and seeking his reward from Allah will have his past sins forgiven."

 

And in a different narration that Abu Hurayra (ra) related that the Prophet (saw):

 

«مَنْ قَامَ رَمَضَانَ إِيمَانًا وَاحْتِسَابًا، غُفِرَ لَهُ مَا تَقَدَّمَ مِنْ ذَنْبِهِ»

 

"Whoever stands (in the voluntary night prayer of) Ramadan out of faith and in hope of reward, his previous sins will be forgiven."

 

Dear brothers, in the month of Sha'ban in the second hijri year, Allah Almighty made fasting the month of Ramadan obligatory. It is the month that the Quran was sent down

 

((شَهْرُ رَمَضَانَ الَّذِي أُنْزِلَ فِيهِ الْقُرْآنُ هُدًى لِلنَّاسِ وَبَيِّنَاتٍ مِنَ الْهُدَى وَالْفُرْقَانِ ))

"The month of Ramadhan [is that] in which was revealed the Qur'an, a guidance for the people and clear proofs of guidance and criterion."

 

It is the month that Allah honored the Ummah with distinct conquests and victories. The great Battle of Badr on the 17th of Ramadan was when the polytheists of Mecca were wholly defeated.... and other critical battles were in this blessed month, starting with the conquest of Mecca that was on 20 Ramadan al-Mubarak in the eighth Hijri year, to the Battle of al-Buwayb, (near modern day Kufa) that was Persian Yarmook, when the Muslims were victorious under the leadership of al-Muthanna on 14 Ramadan of the year 31 AH, then to the conquest of ‘Amooriyah under the leadership of al-Mu'tasem on 17 Ramadan year 213 AH, and to the Battle of Ayn Jaloot when the Muslims defeated the Tatars on 25 Ramadan year 658 AH to other victories in this blessed month....

 

And so fasting was indicated with the Holy Quran which shall not be affected by any falsehood ...And fasting was indicated with distinct conquest and victory.... And fasting was indicated with Jihad.... Fasting was indicated with the implementation of Allah's Laws.... And everyone with clear vision and insight realizes that Allah Almighty's Laws cannot be separated from one another, whether they are acts of worship or Jihad or transactions or morals or conduct, or crimes and punishments.... For all of these are the same problems and whoever ponders the verses of the Holy Quran finds that this is explicitly clarified. Likewise it is clear in these verses of fasting and what comes before and afterwards, in the following:

Allah the Almighty revealed the verses of fasting in Surat al-Baqara, in the second part in the second quarter of it, which begins with His (swt) saying:

 

((لَيْسَ الْبِرَّ أَنْ تُوَلُّوا وُجُوهَكُمْ قِبَلَ الْمَشْرِقِ وَالْمَغْرِبِ وَلَكِنَّ الْبِرَّ مَنْ آمَنَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ وَالْمَلَائِكَةِ وَالْكِتَابِ وَالنَّبِيِّينَ...))

"Righteousness is not that you turn your faces toward the east or the west, but [true] righteousness is [in] one who believes in Allah, the Last Day, the angels, the Book, and the prophets..." up until His (swt) saying:

((أُولَئِكَ لَهُمْ نَصِيبٌ مِمَّا كَسَبُوا وَاللَّهُ سَرِيعُ الْحِسَابِ))

 

"Those will have a share of what they have earned, and Allah is swift in account."

 

And by pondering these verses it becomes clear that they include laws of righteousness and faith, and of retribution, and commandment, and the verses of fasting, and of supplication... and the rulers and the consumption of unlawful wealth, and fighting in the name of Allah, and Hajj. For Allah's laws are all taken together, and there is no difference between one law and another or between one obligation and another, for the One who    revealed the acts of worship is Him (swt) is the One who revealed the laws of transactions, punishments, politics and Jihad, and revealed the morals, provisions, clothing and others. And they are all equal in strength of how they should be implemented and observed, for the obligation in acts of worship is exactly like that of obligation in transactions, like that of obligation in punishments and obligation in the Bayah of the Khaleefah, Jihad and other Ahkam (laws), it is not permissible to separate them in any case, for Islam is one whole, that cannot be separated, and the call to Islam is one call to be implemented in the State, life and society. Therefore whoever separates the verses of Allah and calls for the separation between religion and life, or the separation between religion and politics; thereby has committed a great sin and heavy crime that will lead that person to humiliation in this life and to a painful torment in the Hereafter.

 

 

And in conclusion, Allah Almighty mentioned the act of supplication in between the verses of fasting in Surat al-Baqara, and the Almighty said:

((وَإِذَا سَأَلَكَ عِبَادِي عَنِّي فَإِنِّي قَرِيبٌ أُجِيبُ دَعْوَةَ الدَّاعِ إِذَا دَعَانِ فَلْيَسْتَجِيبُوا لِي وَلْيُؤْمِنُوا بِي لَعَلَّهُمْ يَرْشُدُونَ))

 

"And when My servants ask you, [O Muhammad], concerning Me - indeed I am near. I respond to the invocation of the supplicant when he calls upon Me. So let them respond to Me [by obedience] and believe in Me that they may be [rightly] guided."

 

And the partition of the inseparable is proof of the magnificence of the Revealer, for Allah Almighty commanded the fast, then commanded the act of supplication, and then followed with verses of fasting to show to greatness of the act of supplication, so increase supplication in Ramadan, for the Prophet (saw) said in the Hadith that was related by Ahmed narrated by Abu Hurayra:

ثَلَاثَةٌ لَا تُرَدُّ دَعْوَتُهُمْ: الْإِمَامُ الْعَادِلُ، وَالصَّائِمُ حَتَّى يُفْطِرَ، وَدَعْوَةُ الْمَظْلُومِ تُحْمَلُ عَلَى الْغَمَامِ، وَتُفْتَحُ لَهَا أَبْوَابُ السَّمَاوَاتِ، وَيَقُولُ الرَّبُّ عَزَّ وَجَلَّ: وَعِزَّتِي لَأَنْصُرَنَّكَ وَلَوْ بَعْدَ حِينٍ

 

"The supplications of three people are not rejected: the supplication of a fasting person at the time of breaking fast, of a just ruler, and of a person who is wronged. Allah causes their supplications to rise above the clouds, and gates of heaven are opened for them, and Allah says, ‘By My Majesty, I will help you, even if it is after a while."

 

And supplication was mentioned between the verses of fasting as proof for the insistence of supplication in the month of fasting and a statement of its merit and glad tiding of it being answered, for Allah is close and respondent.

 

And the final conclusion, as we must be protective of our fast so Allah may be pleased with us and forgive our sins, thus we should also be keen to work to resume the Islamic way of life with the establishment of the Righteous Khilafah "Caliphate" so that we will be from the victors in this life with the implementation of Allah's Laws, under the banner of Allah's Messenger (saw), Rayat al Uqab, the banner of لا إله إلا الله محمد رسول الله , and likewise be the victors in the Hereafter, Allah willing, under Allah's shade on the Day of no shade except His Shade, and we ask Him that he accept our fasting in this blessed month, whose beginning is mercy, middle is forgiveness, and end is a shield from the Fire. And when next Ramadan arrives, there will be a Righteous Khilafah "Caliphate" on the way of the Prophethood that has honored us and returned the Ummah as the best Ummah.

 

((كُنْتُمْ خَيْرَ أُمَّةٍ أُخْرِجَتْ لِلنَّاسِ تَأْمُرُونَ بِالْمَعْرُوفِ وَتَنْهَوْنَ عَنِ الْمُنْكَرِ وَتُؤْمِنُونَ بِاللَّهِ))

 

"You are the best nation produced [as an example] for mankind. You enjoin what is right and forbid what is wrong and believe in Allah."

 

And the Khaleefah will be as the Prophet (saw) said,

 

«إِنَّمَا الْإِمَامُ جُنَّةٌ، يُقَاتَلُ مِنْ وَرَائِهِ، وَيُتَّقَى بِهِ...»

 

"Behold, the Imam is but a shield from behind whom the people fight and by whom they protect themselves." Extracted by Muslim on the authority of Abu Huraira (ra).

 

That the Khaleefah will have eradicated the tyrants in the land of al-Sham, and rescued its Muslims, the elderly, women and children, from the filth of the tyrants and oppressors... and that we be behind him to eliminate the tyrants from the land of Islam, and implement the laws of Islam, so that the strife in Egypt and besides Egypt that is a result from the absence of the implementation of Allah Almighty's Law... and then he will lead us to liberate Palestine, all of Palestine, from the filth of Jewish state to restore al-Quds, the land of Isra' and Mi'raj of the Messenger of Allah (saw), will return honored and dignified by Islam, and by the army of Islam.... And we will fight behind him to liberate Kashmir as well, and the rest of the occupied Islamic land, from the Kaffir Imperialists, so that there will not remain an inch of Islamic land that is not shaded by the banner of Islam,

 

((وَيَوْمَئِذٍ يَفْرَحُ الْمُؤْمِنُونَ * بِنَصْرِ اللَّهِ يَنْصُرُ مَنْ يَشَاءُ وَهُوَ الْعَزِيزُ الرَّحِيمُ))

 

"And that day the believers will rejoice * In the victory of Allah. He gives victory to whom He wills, and He is the Exalted in Might, the Merciful."

Results of the Moon Sighting of Ramadan

"Ramadhan is the (month) in which was sent down the Qur'an, as a guide to mankind, also clear (Signs) for guidance and judgment (Between right and wrong). So every one of you who is present (at his home) during that month should spend it in fasting, but if any one is ill, or on a journey, the prescribed period (Should be made up) by days later. Allah intends every facility for you; He does not want to put to difficulties. (He wants you) to complete the prescribed period, and to glorify Him in that He has guided you; and perchance ye shall be grateful." [TMQ 2:185]

The Answer to the Question: The meaning of the Hadeeth: «إِنَّ اللَّهَ يَبْعَثُ لِهَذِهِ الْأُمَّةِ عَلَى رَأْسِ كُلِّ مِائَةِ سَنَةٍ مَنْ يُجَدِّدُ لَهَا دِينَهَا» "Verily Allah sends to this Ummah at the head of every one hundred years someone wh

Question:

Baraakallahu Bika our Sheikh and may Allah hasten the victory at your hands and may Allah benefit us with your knowledge.

From amongst the well-known Saheeh Ahaadeeth that was related by the noble Sahaabah Abu Hurairah (ra) from the Messenger of Allah (saw) that he said:

{ إِنَّ اللَّهَ يَبْعَثُ لِهَذِهِ الْأُمَّةِ عَلَى رَأْسِ كُلِّ مِائَةِ سَنَةٍ مَنْ يُجَدِّدُ لَهَا دِينَهَا}

"Verily Allah sends to this Ummah at the head of every one hundred years someone who will renew the Deen for her". Related by Abu Daawood (4291) and was verified as Saheeh by As-Sakhaawiy in ‘Al-Maqqsid Al-Hasanah' (149) and Al-Albaaniy in ‘As-Silsilah As-Saheehah' (599).

And the question is: Does the word ‘Man' (who) mentioned in the Hadeeth establish that the Mujaddid is an individual or a group? And is it possible to list them from the previous passed centuries?


Answer:

Wa Alaikumus Salaam Wa Rahmatullahi Wa Barakaatuhu,

Yes, the Hadeeth is Saheeh and there are five issues that relate to it:

1) At which date does the hundred (years) begin? Is it from the birth of the Messenger of Allah (saw) or from the time of the Ba'thah (the mission) or from the time of the Hijrah or from the time of his death (saw)?

2) Is the start of every year mean at the beginning of every hundred, or during each hundred or at the end of every hundred?

3) Does the word ‘man' (who) mean one of the people or does it mean a group that renews the Deen for Deen for the people?

4) Are there any reports containing a correct reference in regards to the number of Mujaddids in the past hundreds of years?

5) Is it possible to know in the fourteenth century that ended on the 30th of Dhul Hijjah 1399 AH who the one renewing the Deen of the people was?

I will attempt to the best of my ability to mention what I believe to be the strongest view (Raajih) in regards to these issues without delving and plunging into the points of Ikhtilaaf (difference).

So I say and with Allah is the Tawfeeq and He is Al-Haadi (who guides) Subhaanahu to the straight path:

1) On which date does the hundred years start?

Al-Munaawiy said in the introduction of ‘Fath ul-Qadeer': [And they have differed in regards to the start of the year, is it considered to be from the Prophetic birth, the Ba'thah (start of the mission), the Hijrah or his death (saw)...? And the Raajih (strongest view) in my opinion is that it is to be considered from the time of the Hijrah. This is because it is the date in which the Muslims and Islam was given honour and might (‘Izzah) with the establishment of its state. And it is for this reason that when ‘Umar (ra) gathered the Sahaabah to agree upon the beginning of the date they depended upon the Hijrah. At-Tabari in his ‘Taareekh' said: "Abdur Rahman Ibn Abdullah Bin Abdul Hakam told me: He said: Nu'aim Bin Hammaad told us: He said: Ad-Daraawardiy told us from Uthmaan Bin Ubaidullah Bin Abi Raafi' who said: I heard Sa'eed Bin Al-Musayyib say: Umar Bin Al-Khattaab gathered the people and asked them. He said: From what day should we record? So Ali said: From the day that the Messenger of Allah sallalahu alaihi wassallam made Hijrah and left the land of shirk. So this is what Umar (ra) did." And Abu Ja'far said: "The first year of Hijrah is considered from Muharram of that month i.e. before the arrival of the Messenger of Allah sallalahu alaihi wassallam to Al-Madeenah by two months and some days as the arrival of the Messenger of Allah (saw) was on the 12th of Rabee' ul-Awwal."

Based upon this that it is most probable to start the count of the hundred year mark from the date of the Hijrah (migration) in which the Sahabah (radhallahu alaihum) had adopted.

2) As for the start of the century then the probable (Raajih) view is towards the end; i.e. the Renewed (Mujaddid) would be at the end of the hundred years a pious unblemished famous Aalim (Scholar) and his death would be at the end of it and not half way or throughout its period. As for why I have took this view to be the most probable for the following reasons:

a) It has been confirmed by Saheeh narrations that ‘Umar Ibn Abdul Aziz came at the start (Ra's) of the first hundred years and he died (rh) in the year 101 Hijri when he was forty years old whilst Ash-Shaafi'i was at the start (Ra's) of the second century and he died the year 204 Hijri at the age of fifty-four.

So if we take another interpretation for the start (Ra's) of every hundred years by explaining it as the beginning of the first 100 hundred years then Umar Ibn Abdul Azeez would not be the Renewed (Mujaddid) of the first century because he was born in the year 61 Hijri. And Ash-Shaafi'iy would not have been the Mujaddid of the second century because he was born the year 150 Hijri. This means that the start (Ra's) of the year that is quoted within the Hadeeth refers to the last part of the century and not its beginning. So he (the Mujaddid) could be born within it (i.e. middle years) and then became a well-known Mujaddid Scholar in its latter part and died at its end.

b) As for the evidence indicating that Umar Ibn Abdul Azeez was the Mujaddid of the first century and Ash-Shaafi'i was the Mujaddid of the second century, who became famous amongst the Ulemaa of this Ummah and its Imaams. Az-Zuhriy and Ahmad Bin Hanbal amongst others from the early and later Imaams agreed that from the Mujaddideen at the  start (Ra's)  of the first century was Umar Ibn Abdul Azeez (rh) and at the Ra's of the second century was Imam Ash-Shaafi'iy (rh). ‘Umar Ibn Abdul Azeez passed away in the year 101 Hijri at the age of forty years and the duration of his Khilafah "Caliphate" was two and a half years whilst Ash-Shaafi'i died in the year 204 Hijri at the age 54. And Al-Haafizh Ibn Hajar said in ‘Tawaaliy At-Ta'sees': [Abu Bakr Al-Bazzaar said: I heard Abdul Maalik Bin Abdul Hameed Al-Maymooniy saying: I was with Ahmad Bin Hanbal whilst Ash-Shaafi'i was mentioned so I saw Ahmad raise his head and he related from the Prophet (saw) that Allah Ta'Aalaa selects someone at the start (Ra's) of each century somebody that would teach them their Deen. He said: And Umar Ibn Abdul Azeez was at the end of the first century and I hope that it was Ash-Shaafi'i who was at the end of the second].

And by way of Abu Sa'eed Al-Firbaabiy he said: Ahmad Bin Hanbal said: Verily Allah selects for the people at the Ra's of every century someone who will teach the people the Sunan and will negate the lies attributed to the Prophet so we examined it and found that Umar Ibn Abdul Azeez was at the Ra's of the first century whilst Ash-Shaafi'i was at the end (Ra's) of the second century.

Ibn ‘Addiy said: I heard Muhammad Bin Ali Bin Al-Husein saying: I heard our companions saying: In the first century it was Umar Ibn Abdul Aziz and in the second it was Muhammad Bin Idrees Ash-Shaafi'i.

And Al-Haakim recorded in his ‘Mustadrak' from Abu ul-Waleed who said: [I was in assembly with Abu-l-Abbaas Bin Shuraih when a Sheikh came to him and praised him. Then I heard him say: Abu At-Tahir Al-Khawlaani told us and secondly Abdullah Bin Wahb: Sa'eed Ibn Abi Ayyoob informed me from Shuraaheel Bin Yazeed from Abu ‘Alqamah from Abu Hurairah (ra) that the Messenger of Allah (saw) said:

«إِنَّ اللَّهَ يَبْعَثُ عَلَى رَأْسِ كُلِّ مِائَةِ سَنَةٍ مَنْ يُجَدِّدُ لَهَا دِينَهَا»

"Verily Allah sends to this Ummah at the head of every one hundred years someone who will renew the Deen for it." So have glad tidings O Judge verily Allah sent at the end of the first century Umar Ibn Abdul Azeez and at the end of the second century he sent Muhammad Ibn Idrees Ash-Shaafi'i...].

Al-Haafizh Ibn Hajar said this indicates that the Hadeeth was well-known (Mash'hoor) in that time period.

c) It could be said that the start (Ra's) of something linguistically means the first or beginning part so how then can we view as strongest that the start (Ra's)  of every year means its end and not its beginning? The answer to this is that just as the Ra's means the start of something linguistically (in the Arabic language) it likewise means its end part. It was said in ‘Taaj Al-Aroos' (Dictionary): The Ra's of the thing is its edge and it is said its end part. And it is said in ‘Lisaan Al-Arab (Dictionary): The lizard came out of the hole with its Ra's (Muraa'san) which means that the head came out first or that perhaps tail first i.e. the first part of the end part. Therefore the Ra's of a matter or thing can according to the language mean the beginning just as it can mean the edge of it whether this means the beginning or the end. As such we need a Qareenah (clue/indication) that will outweigh the meaning that is intended in the Hadeeth ‘Ra's of a hundred years'. Is it its beginning or its end? And this Qareenah is present in the previous narrations which considered Umar Ibn Abdul Azeez the Mujaddid of the first century and he died in the year 101 Hijri and considered Ash-Shaafi'i the Mujaddid of the second and he died in the year 204 Hijri. All of this outweighs the meaning in the Hadeeth to mean the last part of the century and not its beginning part.

So based upon the aforementioned, I outweigh to be most probable that the meaning of: ‘The Ra's of one hundred years' as found in the Hadeeth, is the last part of each century.

3) As for the word ‘Man' (who) meaning the individual or a group: Then the Hadeeth states: «يبعث لهذه الأمة... من يجدد لها دينها»

"Allah sends to this Ummah.... someone who will renew (Man Yujaddidu) its Deen for it" and if the ‘Man' (who) indicated the group then the verb would have been in the plural form (yujaddidoona). However the verb was mentioned in the singular form and this is despite the expression ‘Man' (who) also carrying the meaning of the plural and even if the verb after it is in the single form. However I view as strongest that here it is indicating the individual because of the Qareenah ‘yujaddidu' (i.e. singular form of verb). And I say stronger view because the expression used here is not definitely individual here and even when the verb after it is in the singular form. Due to this there have been some who have interpreted the expression ‘Man' as indicating the group and they listed in narrations groups from the Ulamaa who came in every century. However this opinion is outweighed by the other one as has been mentioned earlier.

In conclusion the stronger view is that ‘Man' (who) indicates and individual meaning that the Mujaddid mentioned in the Hadeeth is a man who is an individual pious and untarnished scholar.

4) As for listing the names of the Renewed (Mujaddideen) throughout the past centuries; reports have shown, the most well-known list is in the form of rhyming prose of As-Suyooti up until the ninth century and he asked Allah (swt) for himself to be the Mujaddid of the ninth century. I will now relay a section from his prose:

Thus at the first century was ‘Umar the just Khaleefah as agreed upon and settled.

And Ash-Shaafi'i was at the second due to his high knowledge.

And the fifth was Al-Ghazaali for what he possessed of argument.

And the seventh who elevated to elevation was Ibn Daqeeq Al-Eid as agreed upon.

And this is the ninth that has come and the one who guides does not break a promise and I have hoped that I am its Mujaddid because the favour of Allah does not exhaust.

And there are some other statements that continue on from.

5) And is it possible for us to know who the Renewed (Mujaddid) of the Deen of the people was for the 14th century ending on the 30th of Dhul Hijjah 1399?

It was brought to my attention what was famous or well-known from amongst the well-respected Ulemah when they indicated that the ‘Ra's' (head) of the year was its latter part. Umar Ibn Abdul Azeez was born in 61 Hijri and died at the Ra's of the first century in the year 101 Hijri and Ash-Shaafi'iy was born in the year 150 Hijri and died at the Ra's of the century in the year 204 Hijri.

This means that each one of them was born around the middle of the century and became well-known in its latter part. And as I have said I view as the strongest interpretation that has become well-known amongst the respected Ulemah in regards to Umar Ibn Abdul Azeez being the Mujaddid of the first century and Ash-Shaafi'i being the Mujaddid of the second century. So based upon this, I view as strongest that the great scholar Taqiudeen An-Nabahani (rh) was the Mujaddid of the fourteenth century. He was born in the year 1332 Hijri and he became well-known in the latter part of the fourteenth century and specifically when he founded Hizb ut Tahrir in Jumada al-Thani in the year of 1372 Hijri and he passed away in the year 1398 Hijri. His Dawah to the Muslims was related to the vital issue, the resumption of the Islamic way of life through the establishment of the rightly guided Khilafah "Caliphate" State and it had a major effect upon their lives and endeavours and Ijtihad until the Khilafah "Caliphate" has become a general demand of the Muslims today. So Allah's mercy be upon Abu Ibrahim and Allah's mercy be upon his brother Abu Yousuf who came after him and May Allah gather them with the Prophets, truthful, Shuhadaa and Saaliheen (righteous) and what great company they are.

This is what I view as the most probable my brother Abu Mu'min and Allah is more aware of what is correct and to Him belongs the best of destinations.

Press Release Australian Government Criminalises Resistance to Assad Terror

The Attorney-General, Mark Dreyfus, listed Jabhat al-Nusra as a "terrorist organisation" last Friday, 28 June 2013, supposedly because of various randomly-adduced actions and links deemed "terrorist" and because it, "is not part of the National Coalition for Syrian Revolutionary and Opposition Forces, which Australia acknowledges as the legitimate representative of the Syrian people." The Government also took the opportunity to re-iterate its deplorable stance on the conflict in Syria.

"The Australian Government's stance of Syria is immoral and criminal. It criminalises supporting those who are being slaughtered like animals by the Syrian regime. We condemn it in the strongest of terms. Muslims in Australia are not fooled by the Government's hollow claims of deploring the violence and suffering occurring in Syria. Its actions speak louder than its words."

"The position of the Government is like that of someone who sees a house on fire and not only suffices himself by merely watching on from the sidelines but also stops others who want to go in and assist those caught up inside, instead telling them to wait outside for the dead and injured bodies to come out and provide them with "humanitarian" support. There is nothing humanitarian about this."

"Listing groups fighting the Syrian regime as terrorist organisations is laughable coming from a government who, by its own definition of "terrorism" and "violent extremism", self-evidently qualifies for both. The foreign policy of Australia and "like-minded" states is built on the use of violence for political ends. We challenge the Attorney-General to demonstrate how the wars in Iraq and Afghanistan do not fall under his government's own definitions of terrorism. Indeed, he should be listing his own government as a terrorist organisation."

27th Summer Universiade in Russia

Event:

27th Summer Universiade is held in Russia from 6 to 17 of July 2013. Kazan has become the capital city of world student and youth sporting contests. This Universiade will be the greatest in the history of such events. Athletes from more than 170 countries will compete for more than 350 sets of medals in 27 sports.

Comment:

For the first time the Russian government has decided to hold such a major international event in the Volga region, that densely populated with 40% of all Muslims of Russian Federation. Totally there are seven republics with dominating Muslim population in Russia, two of them, such as Tatarstan and Bashkortostan, are in the Volga region. 4.5 million of Tatars and 1.5 million of Bashkirs live in these lands.

According to recent analyzes provided by Russian experts the Volga region is assessed as not trustworthy in terms of loyalty to the Russian authoritarian system. The reason for this according to those same experts is the revival of Islam among the Tatars and Bashkirs.

In this regard, the preparation and holding of the World Universiade are connected with providing tight security by the Russian government and its security forces. Numerous officials of Ministry of Internal Affairs, Federal Security Service and the Russian Ministry of Defense are concentrated in Tatarstan. Against the background of this international event, the fruits of anti-Islamic policy of the Russian authorities, expressed in discrediting and humiliation of Islam and Muslims, are becoming apparent more and more. The security forces' officials visit the houses of Muslim activists, conduct searches, seize the Islamic attributes such as flags of the Messenger of Allah (peace be upon him) from the cars belonging to the Muslims, and then subject them to administrative arrests.

Thus, an attempt to remove from the streets of Kazan any manifestations of Islam is made. The Russian authorities do not hide now their plans to oust Islam from public life of the country.

The need for a political term "Wahhabism", which should cover all those Muslims in whose loyalty the Russian authorities doubt, is imposed on the society openly. Government agencies controlling the religious life of Muslims propose to create intolerable conditions of life for the Muslims, who will be on the lists of "Wahhabists". On the 22nd of June, the Russian government made tightening in the legislation directed against the unofficial Muslim movements, increasing prison sentences for the organization and activities in the Islamic political party "Hizb ut-Tahrir" and other Islamic Jamaats. On the 1st of July the law banning Muslim activists convicted for having a religious position contrary to the position of the Russian authorities to establish and participate in public and religious organizations was amended. The Minister of Justice said that the main purpose of the bill is aimed at stopping the activities of banned Islamic organizations.

Question and Answer The Continuing Protests in Turkey

Question:

The protests are still continuing in Turkey, but not with the momentum as the first days of 31/5/2013 in Taksim square in Gazi Garden. People were protesting against the uprooting of the park's trees, executing government plans to transform the barracks to the Ottoman era into a commercial and residential area, so protests ensued the next day not less than 67 cities. The clashes took place between protesters and security forces who wanted to end their protests. Several people were killed and hundreds of protesters and police were injured, and hundreds of protesters were arrested, and arrests are continuing even today in search for the instigators. What are the causes of these protests and who were behind them and what is their aim?

There is something that brings about attention and that is the protesters' laid-back attitude towards President Abdullah Gül and the harsh attitude towards Erdogan. The protesters are more satisfied with Abdullah Gül, more than with Erdogan. Does it mean that America has started to advance Abdullah Gül over Erdogan in the administration of the country's affairs, to absorb the indignation of the protesters? And is that expected in the future?

Answer: To clarify the answer, we present the following points:

1. The Turkish Prime Minister Erdogan accused the internal and external forces and international media of inciting these events. He mobilized hundreds of thousands of supporters in Kazlicesme Square in Istanbul on 17/6/2013 in response to the protesters demonstrations as a display of people's support. He attacked the European Union on their position towards the events. He was nervous and worried in his statements, and he was sarcastic and aggressive. He described the protesters as a bunch of miserable and rubbish people. They are under the commands of a lobby which is only concerned about money, and they are a tool exploited in the hands of the foreign powers. Along with other accusations, this amplified the reaction and inflamed anger against him. He conveyed his anger towards everything that has happened and towards the perpetrators. He did not expect this situation to happen, the events were a surprise for him and he was afraid that it would take the same form as the uprisings in the Arab countries. It shook his reputation and the reputation of the secular democratic model which America marketed to the Arab world in his (Erdogan) name.

2. With regards to the Turkish Deputy Prime Minister, Bakr Bozdag, he as well called and attacked the protesters and the forces of the political opposition, saying: " The participants in the protests in Gezi Park are the same ones who participated in the 2007 protests and they called on " the army to do its task" which was to carry out a coup. Most of them are members of the People's Party, Peace and Democracy Party and the Labor Party and they use the mask of the left wing. He denied that the protests were a popular movement. He said that behind this are internal and external forces. He wondered how they say that they are against capitalism and in the same time benefit from global capital institutions and works for them. He said that the Alawites were officially addressed for the first time in the era of his government, and their religious manifestation and houses of worship were banned at the time of the Republican People's Party due to the application of the laws of the Revolution (Kemalism). (Radikal Page 21/6/2013) it was stated that the participants in these protests are those who participated in the protests in 2007, but he did not say that they had knowingly planned for this arrangement. His accusation against every opposition party with tendencies towards the left, liberal and socialist is in order to limit the official political opposition and further it from the public character. The Turkish Interior Minister Muamer Guler stated: "There is a will to push people to spill onto the streets through illegal acts, such as stopping work and strike." He also said: "It is impossible to understand the insistence on the continuing demonstrations," (AFP 17/6/2013) after he called for a union gathering, uniting two central major unions for workers and state employees that contain hundreds of thousands of members. He invited them to a general protest in every public place in Turkey to condemn the acts of violence committed by the police against the demonstrators. Therefore the Interior Minister believes that there is a force who wants to continue the events so it can exploit it for certain goals.

3. It appears that the government feared the escalation of events in a serious manner, compelling the Turkish Deputy Prime Minister Bülent Arinc to announce: "The police will use all its forces to end the protest, and if that is not enough we may even use Turkish armed forces in the cities." (Reuters 17/6/2013) At the same time, Erdogan threatened the protesters, saying: "Our patience is starting to run out, and I warn you for the last time" (official Turkish television, 13/6/2013) and the Liberties site has reported on 21/6/2013 that the Prime Minister Erdogan has met with the President Abdullah Gül and then met with the head of Turkey's Intelligence Services, Hakan Fidan, and then had an emergency meeting with the Chief of Staff Necdet Ozeln and all those meetings took place on the day of 21/6/2013 discussing the protests in his meetings. This indicates his fear of negative repercussions in the long term if it is not treated once and for all. Three weeks have passed and it has yet to end completely, and there will be a National Security Council gathering on the 25/6/2013 to discuss how to confront the protesters.

4. Despite this, the position of the Turkish President Abdullah Gül was lenient to show his understanding, which brought him support. Abdullah Gül stated, after praising "democracy" and considered it "the greatest wealth for the community", he expressed his regret towards the Taksim events, and said, "it is to the extent of worrying and we all have to be mature so that the protests that have reached alarming level have to subside."  It was also stated, "This morning he met with the Prime Minister and other officials in the governments and the state, and discussed how to calm this situation, with a manner fitting for us" (Journal Star 1/6/2012) in this statement he indicates the government and its president. That is he calls the government and its President to demonstrate maturity so they can calm the protesters. After these events, it has been observed that Erdogan is trying to draw closer to the President of the Republic after the aloofness between them during the last period. During his visit to the city of Kayseri in 21/6/2012 where his Party organized a large gathering to renew the support from his people, he praised the people, saying: "Kayseri is the town of my brother Abdullah Gül." It was interpreted that it was an attempt to reconcile with Abdullah Gül, whose statements steered in another direction contrary to Erdogan's statements.

5. As for the Republican People's Party's stance, they have announced that they have nothing to do with the events. The MP of the Republican People's Party Erdal Oxngar confirmed that: "his party does not regulate these protests, rather the Turkish youth are the ones who hold them because they are tired of Erdogan‘s decisions which infringe on their personal freedom" (Sky News Arabia 4/6/2013). The People's Party did not adopt protests, neither did they lead them, they also prevented raising their flags in fear of being held responsible for the violence, as its officials announced. However, the party worked on exploiting these events in its own favor as an opposition party.

6. The American stance: Jennifer Bsaki, the spokeswoman for the U.S. Secretary of State stated: "That the best way to ensure stability, security and prosperity in Turkey is to support the freedoms of expression, assembly and association that these people used to apparently practice" and she expressed her concern about the people who were injured in the protests (Aljazeera 1/6/2013). The U.S. Ambassador in Turkey, Francis Richardony expressed after his visit to the Party of Justice and Development headquarters in Ankara, saying: "Turkey is a friend and an ally to the U.S., even in times of hardship and in critical situations." He also added: "There is no difference between Turkey‘s and America's democratic principles". (The Process 20/6/2013). By this, the Americans demonstrated their support for Erdogan with their claim that they support freedom of expression and the formation of associations that desire to express their views. But the American Christian Science Monitor Newspaper commented on the events on 4/6/2013 saying: "Peaceful protests in Turkey against the increasingly authoritarian rule of Erdogan's Islamic-based party are a needed corrective, not a revolution. They show a fearless, tweet-oiled, even leaderless uprising to save democracy". So the U.S. sought a containment of any movement taking place in Turkey, as they did in other coutries across the world, so that they do not lose control of it. Hence they adopt anti-democratic antics, criticizing those who do not abide by it even if they were of their agents, in order to prove their leadership to the world and prevent losing control of the situations by working on containing any opposition. Especially that there are groups and individuals in Turkey, of writers and journalists, who are in favor of the U.S. politics, were supporters of Erdogan, but a while ago they criticized him and described him as a dictator.

7. As for the European stance; all the European nations, without exception, led by Britain and its official news agency BBC (which Erdogan criticized by name), including all the European media, even the local media which has nothing to do with news related to foreign policy, followed these events carefully and took a position that is counter to Erdogan and his government and in favor of the protestors. The European Union announced in Brussels regarding "their deep concern about the use of excessive violence and violent police intervention against the people protesting in a peaceful and ligitimate manner, and they warned Turkey from adopting harsh measures against the peaceful demonstrators" (World Bulletin Turkey 20/6/2013) The Turkish Foreign Minister Davutoglu criticized the EU's statement saying: "When we receieve it, we will reject it immediately" (same source). On 21/6/2013, Germany summoned the Turkish ambassador, seeking clarifications regarding the repression of Turkish police towards the protestors, this move was a diplomatic expression showing Germany's stance alongside the protestors against the Turkish government. The German PM described this repression as very harsh, hence Turkey reacted to that by summoning the German ambassador. Germany and Holland also opposed the opening of a new chapter in the negotiations regarding Turkey's accession to the EU because of that repression, allowing the conduct of protests in Germany organised by Allawites; this proves that Europe wanted to exploit the events and the Allawites against Turkey because of Turkey's link with the U.S. politics, and to justify its rejection to Turkey's accession to the EU, setting new obstacles its way.

8. The topic of the so-called "Allawites" has appeared, most of whom are involved in leftist or communist or liberal or democratic or Kemalist organisations, as well as the People's Kemali Party which is headed by one of them, i.e. they engage themselves in any anti-Islam movement and take any opportunity to protest against anything related to Islam or the the Ottoman State. They are also standing against naming the third suspension bridge as the Bridge of Sultan Salim I, which the government is working to build over Bosphurous in the pretext that this Sultan had persecuted them when they wanted to go against the Islamic State. President Abdullah Gul noted: "He sensed some sensitivity towards launching the name of Sultan Salim I to the third linking bridge in Istanbul"  he also pointed out that "they (i.e. the state) will name some future projects in Turkey by the names of Pil Sultan Abdal and Haji Piktash Wali, who are considered of the leading Alawite sect" (Turkish Ceyhan agency 19/6/2013). By this, he tried to show a lenient attitude towards the protesting movements.

9. Some pointed their fingers at Iran, that it had played a role in fueling the events, hence the state began to search for Iranians accused of taking part in fueling events. There are also Alawites who are anti-Iran, Ozdemir Ozdemir the head of the Alawite Bektashi Turkmen Turkish Movement said: "Iran has stepped up its efforts, especially during the last three years to bring about a sectarian conflict between Sunnis and Alawites in Turkey."  He considered the Taksim demonstrations as part of the events aimed at achieving this scenario. He also said that "Tehran is implementing the subversive plan across four Alawite associations in Istanbul, Ankara and Izmir." (Ceyhan agency 20/6/2013)  Erdogan referred to this issue in his speech in Kayseri in front of his supporters, saying: "There is someone who seeks to play a dangerous game on the Alawites."  The People's Party plays the main role in moving this dirty game. The president of the People's Party and some members of the parliament belonging to the party are playing the main role in this game. As well as some spots outside of Turkey are taking part in this game dirty. He also stated that "there are those who want to sabotage the solution we reached to settle the events of Gezi Garden, hence they want to continuously ignite the events, and open fire on the police."  He addressed the People's Party and leftists that they provoke the situation and follow terrorist and extremist movements, and the outlawed "(Milliyet Turkish Newspaper 21/6/2013). A leftist organizations calling itself  the Red Hack / Red Pirates claimed responsibility for sending the tweets on Twitter. Police have investigated the 5 million Tweets. The Turkish Deputy Prime Minister Bulent Arinc, commented, "social media platforms are used to promote crime and violence, and that deterrent measures will be taken." (UBI 20/6/2013). Iran has an interest in exploiting these events, thus it is in contact with the Alawites, working on containing them; as it is also in contact with other forces, working on attracting them to its side in order to achieve its  interests and build up  followers and supporters, but this will not reach to it playing the role of the President to drop the Turkish government, neither perform any serious work. Keeping in mind that their relationship with the Turkish government did not deteriorate, the relations between them are still ongoing and are not bad and trade relations between them are strong. Also noting that Turkey and Iran are both hand in hand within the U.S. circle.

10. Criticisms of Erdogan emerged from some of the groups that consider themselves Islamic yet support American policy, and they wrote about Erdogan describing him as conceited and saying that he should heed the advice, meaning the advice of their group, and that he should not deceive himself, and they praised Abdullah Gul saying that he is democratic and humble. And it appears that this group, which is a specific group that is known on the Turkish street as the Fathullah Gulen group, wants to maintain and increase the great interests that it achieved under this government, and its cause does not lie except with that. Two years ago it sought to nominate individuals affiliated or close it to the electoral lists in the June 12, 2011 elections, and when it was unable to succeed; it began to criticize Erdogan's policies, and in fact began to threaten to withdraw its support of the ruling party. Erdogan deposed some of the security officials affiliated with this group, because he did not want this group to penetrate and gain more control of state institutions, which would make him under the group's mercy and be weakened and controlled by it, so he began to clip their wings. This group is not of major political significance, even though it has many members, because it is not a political movement and does not undertake political action, but it does take advantage of political action and its support of parties to achieve its own interests of attaining monetary benefits and increasing its membership and seating the largest number of its members to positions in state institutions. Nevertheless, Erdogan's party won the majority in those elections, with his votes reaching 50%. And when the latest events took place this group and its leaders directly and indirectly expressed criticism of the Prime Minister, as if they were waiting for an opportunity for revenge. Erdogan mentioned to the press during his visit to America last month that his "Deputy Prime Minister Bülent Arınç met with the leader of this group who lives in America  in order to eliminate some circles' negative rumors and speculations about the  relationship of brotherhood and friendship that is based in the past." (Turkish webnews Aktaal 19 \ 5 \ 2013), and when he was asked the following question: "Mr. Abdullah Gul said that he has lost hope in issuing a new constitution, so have you lost hope in that?" He replied: "I answer frankly that likewise I have lost hope." And he said that "we hope to open the door to discussion on the subject of the presidential system." He attacked the opposition and described it as running away from discussing this subject and he asked, "Why is the opposition running away from this discussion and saying that there will be liquidation?"  He said, "If that does not happen then we have the draft constitution and we will resort to Plan C" which means to suffice with the votes from his party and search for some additional votes to complement the quorum, and he said "He needs 330 votes in Parliament to go to national referendum on the constitution but his party has 226 seats in Parliament" and expressed his concern that the members would not vote for that because the voting would be secret. He mentioned that if the needed number of votes was obtained then he would go to three elections in 2014 - local elections and elections for the Presidency of the Republic and a national referendum on the constitution. It appears that America is not very concerned with the amendments to the constitution that deal with the presidential system because it has achieved the control of military leaders that it had dreamed of, along with that fact that the presidency of the republic is in its hand, as well as the government and the head of the government, and it has began to control the judiciary, not to mention the police and state institutions. Therefore, it is not putting its weight behind the new constitution and does not pressure its agents to stand behind it.

11. From all this it is clear that the protests erupted spontaneously and were then exploited by the opposition to Erdogan and those with different political orientations. It does not appear that there was a plan or prior preparations for the protests. There are many who were waiting to ambush Erdogan and for an opportunity to overthrow him and take revenge from him, especially followers of the British camp, as they were harmed by the liquidations and the throwing of many of them in prison. Except that there are individuals of the secular orientation who have the illusion that Erdogan is an Islamist and that he works to return Islam, and they consider his secularism as a kind of hypocrisy that he used to come to power. Especially that those do not understand Islam, and they think that Erdogan's government's legalization of some expressions of religion is proof for their claims, and they do not realize that Erdogan fights the callers to Khilafah "Caliphate" and the rule of Islam, and he does not permit religion except to the extent allowed by secularism.

12. And it is doubtful that these protests will evolve into a revolution that will change the regime because the protestors belong to small sectors of a particular orientation. Half of the population supports Erdogan, and it is doubtful that half of the opposition will join the protestors because it does not belong to the left. Instead it is at heads with the left and is considered from the right in relation to the divisions of the democrats. The parties of the leftist opposition did not claim the protests and did not work to conduct them but only worked to exploit them to win votes. The protests remain confined to a small strip and do not exceed that strip. The media, especially the European media and its affiliates, has overblown these protests. The aim of the Europeans in this was to justify their opposition to Turkey being admitted to the European Union and to hamper the process of admission. In addition, the British work to exploit these kinds of movements to undermine Erdogan's position because he worked to liquidate their agents and threw many of them in prison distancing them from the military leadership. Whatever the case is, these events, and the actions of Erdogan and his government concerning these events, shook the reputation of the Turkish secular democratic model that Erdogan had boasted about and worked to market to the Islamic world on America's behalf and to appease America and to blank without the return of Islam to power, for it is has been shown to be a false reputation and that this secular democratic regime is in reality a tyrannical regime that is prepared to oppress the opposition to it. With the knowledge that this regime brutalizes the callers to the return of the Khilafah "Caliphate" and the rule of Shariah that carry the Dawah politically and intellectually and do not resort to violence whatsoever, so he throws them in prison and sentences them with severe punishments, more severe than the punishments sentenced to those who carry out violence in the streets and squares. However, the local and international media outlets carry out a blackout policy because it is not in their interest to point it out, and because this is related to Islam so the matter is dealt with two faces, and it does not appear that America has abandoned Erdogan, even if it expressed some criticism, so that any movement could arise, and maintain its influence in the country, rather it has expressed its support for him.

13. However, the idea that America is going to present Abdullah Gul over Erdogan in managing the affairs of the country to absorb the resentment of the protesters, this is incorrect, because Erdogan is carrying out America's interests with power that Gul cannot undertake, even though both of them are agents to America, and it uses both in the situation suitable for it. Likewise America's policy in treating the issue of the protests leans toward firmness more than softness because of "American arrogance", except if the issue becomes completely out of America's hands, and the issue has not reached that point up until now, and therefore Erodogan and Abdullah Gul are still in the proper place for America's interests, at least for the foreseeable future. But as for what can be expected in the future, we will follow the issue and Allah willing if anything new emerges then there will be talks.

We ask Allah Almighty to entitle the right and invalidate falsehood in Turkey, and to give victory to the dawah carriers, and to join the Ummah's hearts with them, so that the Khilafah "Caliphate" will rise anew, and return to the land that it had left more than ninety years ago.
