Loya Jirga cannot use shura as a tool to make Haram as Halal
(Translated)

Since last ten years of the blood sucking democracy many ‘Loya Jirgas' are organized under the guise of peoples rule but the sole motive of all these ‘Loya Jirga' is to legitimize the brutal invasion of the America and NATO forces and nothing else. On the coming Wednesday yet again, to give complete authority to the Kufar through strategic pact, a resolution is going to be presented to the Loya Jirga. With regards to this the people of Afghanistan should consider the following points as per the Islamic politics:

1- Jirga is an Afghan tradition and historically started at the time of Kanishka, which proves the fact that it is not an Islamic source rather it is continuation of Jahiliah tradition.

2- It is incorrect to equate Jirga with Shura, because shura's role is limited to consultation only whereas Jirga executes policies and decisions based on other then what Allah (swt) has revealed. Jirga's role under colonial umbrella has been to search ways to find peace deal with the invaders, thus providing legitimacy to invasion. In Islam Shura role has been to have consultative body that provides advice to Khaleefa and Khaleefa decides based on what Allah (swt) has revealed.

3- No one has the authority to change a single rule that has been ordained by Allah, majority vote can't be used to pass amendments. Though by using ‘shura' as a tool Loya Jirga always makes Halal Haram and Haram Halal. It's the same Loya Jirga which favored the American model of governance, laws, help the invaders to strengthen their grip on Afghanistan and now they are trying to legitimize the strategic pact with the same crusaders.

4- Ironically some Islamic groups are of the opinion that Loya Jirga should be used as a platform to stop the strategic pact from happening by convincing people to vote against it. But they don't realize the fact that Loya Jirga in itself is a non-Islamic organization and has no bases whatsoever in Islam. These brothers forget that being part of the non-Islamic organ that does not rule based on what Allah swt has revealed is also Haram. So isn't it the right way to stay away from it and strive to make public opinion against it and to expose the fallacious nature of Loya Jirga and it being a jahilia organ?

5- Since last ten year it is evident without a doubt that through Loya Jirga different foreign embassies, under the guise of people's choice, have been heavily influencing the whole process by giving bribes etc. As a result the people of Afghanistan have been ruined on daily bases, our sacred Islamic traditions, our mothers, sisters, sons and daughters are facing the wrath of these brutal forces. Not only this, they are looting our resources and are introducing the anti-Islamic ideas through different means in our society.

6- It's absolutely forbidden to have any peace deal, strategic pact or any other sort of deal with the aggressors. Quran clearly states:

(وَلَنْ يَجْعَلَ اللَّهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا)

"Allah (swt) has never allowed the Kufar to have any authority over Muslims" (Surah Nisa-141).

Similarly taking help from the Kufar and their armies is utterly forbidden, as our beloved prophet (saw) said:

«لا تَسْـتَضِـيئُوا بـِنَارِ الْمُشْرِكِينَ» "Don't take light from the fire of Kufar" (Ahmed) and fire is an indication of war. Moreover he (saw) said:

«فَإِنَّا لاَ نَسْـتَعِينُ بـِمُـشْـرِكٍ» "We don't seek help from polytheists" (Ibn Haban). And he (saw) also said:

«أنا برٍئ من كل مسلم قاتل مع مشرك» 'I am free (bariu) from every Muslim who fights together with a polytheist' proves the point that signing any permanent treaty of strategic pact with Kufar is absolutely forbidden. Therefore, it is Haram to do any Jirga or consultation in matters that are clearly forbidden.

7- Allah (swt) has given us a complete way of life ‘Islam' and the sources to extract rules, are Quran, Sunnah, Ijma and Qiyas (analogy) and not majority. Allah (saw) said in the Quran:

(وَنَزَّلْنَا عَلَيْكَ الْكِتَابَ تِبْيَاناً لِّكُلِّ شَيْءٍ وَهُدًى وَرَحْمَةً وَبُشْرَى لِلْمُسْلِمِينَ )

"We have sent down to Thee the Book explaining all things, a Guide, a Mercy, glad tidings to Muslims." (Surah al Nahl-89)

O' Mujahid people of Afghanistan! According to the evil plans of American and NATO you can never achieve peace and prosperity. Such type of Loya Jirga and other similar American projects can never legitimize the Haram strategic pacts. Muslims of Afghanistan and of the entire world can only resolve all their problems through the complete implementation of Islam and this is only possible by re-establishing the unified Islamic state ‘Khilafah "Caliphate"', which will implement Islam internally and will take it the entire world through dawah and jihad, as well as will liberate all of occupied lands of the Muslims.
