Is legislating according to the majority vote Islamic?

The Lawmakers voted for the fourth time on Wednesday for the Speaker of parliament, without a clear victory of any candidates. There is yet another round to come.

Muslims of Afghanistan should ask themselves, is it the revealed rule of Allah (swt), or are they acting according to Western Ideas of democracy? Is it not a wasting of time, turning the attention of the Public from the brutality of these treacherous rulers and their masters? Have they not legislated haram as halal like Riba, the occupation of Kuffar and killing of Muslims? 

Besides, it is a lie that the parliament is representing the majority of the people. 1.4 Million Legal votes are counted which amounts to 5.4% of the whole population. The percentage of the drug addicts in Afghanistan goes higher than this. This number of voters does not even represent these drug addicts, how then they claim to represent the whole nation?

Legislation on a basis of majority vote is not an Islamic Verdict. Hizb ut-Tahrir  has advised you during the parliamentary elections' campaign that the idea of an institution like the parliament has a history of at least 2500 years, much older than both Islam and Christianity and the same is true with Afghan Jirga. It is a false argument that Afghan Jirga or Parliament is the same as the Islamic Shura. This Jirga dates back to the time of King Kanishka as some of the historians assert. How could that be Islamic? Neither of these is the same as the Islamic Shura. Not even once, they have been mentioned in Islamic texts.

The parliament does not only have an advisory function but it also legislates. Legislating in accordance to other than Quran, Sunnah, Ijma and Qiyas is unislamic; indeed it is Kufr. Any law derived from other than these sources, is not from Islam, even if the parliament comes to the same conclusion as the Sharia from a different point of view or with a different method other than the islamic-ijtihad, it is counted as unislamic.

( أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ وَمَنْ أَحْسَنُ مِنَ اللَّهِ حُكْمًا لِقَوْمٍ يُوقِنُونَ )

"Do they then seek the judgment of (the Days of) Ignorance (Jahiliyyah)? And who is better in judgment than Allah for a people who have firm belief?" [TMQ: Al-Ma'idah: 50]
