O Aware and Sincere People of the Society! Resist the Government’s Criminal Interference in the Judiciary;

O Judges and Lawyers! Take a Stand for Justice

Recently the High Court bench (Annex court no-18) headed by Justice Sheikh Abdul Awal and Justice Bhismadev Chakraborty rejected the bail of a member of Hizb ut Tahrir, Mohammad Sohel Rana (Age 32, Cyber Crime case no. 119/16). He is being held in jail custody unjustly for about three and half years under the section 57 of the notorious and draconian ‘ICT Act’. This is the 5th time his bail has been rejected just in the higher courts (High Court and Supreme Court). What is astonishing is that his bail was rejected despite the fact that the Deputy Attorney General did not oppose his bail and in fact stated that there are no grounds to reject it!

O Aware and Sincere People of the Society! The injustice on Mohammad Sohel Rana is not an isolated event, but rather, for the members and activists of Hizb ut Tahrir, the sincere sons of this Ummah, unjust denials of bail, prolonged incarcerations and even re-arrests from jail gates, etc., are a regular occurrence. Under this tyrannical regime, the existing law, which has explicit provisions for presenting arrestees to the court within 24 hours, for the right to get bail, is blatantly ignored in case of the sincere members and activists of Hizb ut Tahrir.

The above evil occurrences are the direct result of the criminal interference in judicial matters by this tyrannical Hasina regime to suppress all opposition to the government and its failed policies. Recently, we saw a flagrant manifestation of this on 2nd June, 2019 in the statement of the RAB Head, Benazir Ahmed, who as the head of an executive branch of the government threatened the lawyers working in the judiciary not to give any legal assistance to those he termed ‘extremists’! By bringing in public the government interference (threats and intimidation to judges and lawyers) that till now has been happening behind doors, he has exposed that under democracy the so called ‘rule-of-law’ and ‘human rights’ are nothing but abstract words. The deceitful regime of Hasina wants to conflate the mindless violence carried out by some misguided organizations and individuals with the legitimate political work for Islam, so that in the name of ‘opposing extremism’ they can continue political oppression on Hizb ut Tahrir who are presenting Islamic system as alternative system of rule for the nation, and mobilizing the people against the tyrannical rule of Hasina regime. We strongly condemn this criminal interference by the government in judicial matters, and demand the immediate release of Mohammad Sohel Rana, and all the members, activists and supporters of Hizb ut Tahrir.

O Judges and Lawyers! We call upon you - do not to let the government make you a tool for its tyranny, and do not shy away from fighting for justice. One day, you will also have to stand in the court of Allah (swt) awaiting His (swt) judgment. He (swt) orders you to establish justice and take a stand for justice:

﴿وَإِذَا حَكَمْتُمْ بَيْنَ النَّاسِ أَنْ تَحْكُمُوا بِالْعَدْلِ﴾

“…And when you judge between people, judge with justice.” [An-Nisa: 58]. Do not let the government and its henchmen deceive you into failing to distinguish between legitimate political work for Islam and mindless violence carried out by some misguided organizations and individuals. You are well aware that Hizb ut Tahrir is a non-violent political organization, doing intellectual and political struggle in the method of RasulAllah (saw) to establish the rights and interests of the people. It is an established fact that this party does not have an iota of relationship with any violence. Our demand and expectation from you is that you will take right decisions. O Justices! Be obedient to Allah (swt) while giving verdicts, establish justice for the advocates of the great Deen Al-Islam, and reject the government’s unjust instructions of not giving bail to the advocates of the Khilafah Rashidah (rightly guided Caliphate) and free them from jail.

Finally, we want to remind the Hasina regime again that, in history, rulers like Pharaoh and Nimrod failed to stop the believers, and similarly the tyrant rulers of the present world have also failed and will fail to deter Hizb ut Tahrir from its path, insh’Allah. We are inspired by our desire for Allah’s pleasure, His (swt) power and blessings constantly motivate us, and strengthen our resolve, determination and desire. Therefore, failure is inevitable for all tyrants of this world in the face of this strong resolve and desire. Allah (swt) says:

﴿إِنْ يَنْصُرْكُمْ اللَّهُ فَلاَ غَالِبَ لَكُمْ وَإِنْ يَخْذُلْكُمْ فَمَنْ ذَا الَّذِي يَنْصُرُكُمْ مِنْ بَعْدِهِ وَعَلَى اللَّهِ فَلْيَتَوَكَّلْ الْمُؤْمِنُونَ﴾

“If Allah should aid you, no one can overcome you; but if He should forsake you, who is there that can aid you after him? And upon Allah let the believers rely.” [Surah: Al-i-Imran: 160].
