Sudanese political forces, the Rapid Support Forces, and some armed factions signed what is called the "Founding Charter for the Government of Unity and Peace" in the Kenyan capital, Nairobi, on Saturday, 23 Sha'ban 1446 AH corresponding to 22/02/2025 CE. One of the most prominent points in the charter states: "The establishment and construction of a secular democratic state based on freedom, equality, and justice." The charter also includes: "A ban on the establishment of any party or political organization on a religious basis, or the engagement of any political party or organization in political propaganda based on religion or race." Additionally, the charter states: "The establishment of a genuine decentralized governance system that recognizes the inherent right of all regions to manage their political, economic, and cultural affairs."
We, in Hizb ut Tahrir / Wilayah Sudan, in response to this criminal document, which seeks to fulfill the old and new colonial dream of dividing and fragmenting Sudan and establishing blatant kufr, declare the following:
First: Since the departure of the colonial British kufar, Sudan has been ruled by secularism, which means the separation of religion from life, and thus the separation of religion from the state and politics. However, this was not explicitly stated in the constitutions; rather, they deceived the Ummah with vague phrases such as: "Islam is the official religion of the state" or "Islam is the main source of legislation", and similar statements. But what is explicitly stated in this document is an open opposition to Allah and His Messenger. Allah (swt) says:
[أَلَمْ يَعْلَمُوا أَنَّهُ مَنْ يُحَادِدِ اللَّهَ وَرَسُولَهُ فَأَنَّ لَهُ نَارَ جَهَنَّمَ خَالِداً فِيهَا ذَلِكَ الْخِزْيُ الْعَظِيمُ]
“they not know that whoever opposes Allah and His Messenger - that for him is the fire of Hell, wherein he will abide eternally? That is the great disgrace” [At-Tawba: 63].
Second: The clause that prohibits the establishment of any party or political organization on a religious basis aims to block the path to establishing the rule of Islam, which Allah (swt) has decisively commanded in His (swt) words:
[وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنْزَلَ اللَّهُ إِلَيْكَ فَإِنْ تَوَلَّوْا فَاعْلَمْ أَنَّمَا يُرِيدُ اللَّهُ أَنْ يُصِيبَهُمْ بِبَعْضِ ذُنُوبِهِمْ وَإِنَّ كَثِيراً مِنَ النَّاسِ لَفَاسِقُونَ]
“And judge, [O Muhammad], between them by what Allah has revealed and do not follow their inclinations and beware of them, lest they tempt you away from some of what Allah has revealed to you. And if they turn away - then know that Allah only intends to afflict them with some of their [own] sins. And indeed, many among the people are defiantly disobedient.” [Al-Ma’idah:49].
And He also says:
[فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ ثُمَّ لَا يَجِدُوا فِي أَنْفُسِهِمْ حَرَجاً مِمَّا قَضَيْتَ وَيُسَلِّمُوا تَسْلِيماً]
“But no, by your Lord, they will not [truly] believe until they make you, [O Muhammad], judge concerning that over which they dispute among themselves and then find within themselves no discomfort from what you have judged and submit in [full, willing] submission.” [An-Nisa:65]. This ruling must be established within the state that the beloved Prophet (saw) defined the Khilafah Rashidah (rightly guided Caliphate) on the method of the Prophethood. The Prophet (saw) said: «كَانَتْ بَنُو إِسْرَائِيلَ تَسُوسُهُمُ الأَنْبِيَاءُ، كُلَّمَا هَلَكَ نَبِيٌّ خَلَفَهُ نَبِيٌّ، وَإِنَّهُ لاَ نَبِيَّ بَعْدِي، وَسَيَكُونُ خُلَفَاءُ فَيَكْثُرُونَ» قَالُوا: فَمَا تَأْمُرُنَا؟ قَالَ: «فُوا بِبَيْعَةِ الأَوَّلِ فَالأَوَّلِ، أَعْطُوهُمْ حَقَّهُمْ، فَإِنَّ اللَّهَ سَائِلُهُمْ عَمَّا اسْتَرْعَاهُمْ» “Bani Isra’eel were governed by the prophets, as often as one died another taking his place. There will be no prophet after me, but there will be numerous caliphs.” He was asked what command he had to give and replied, “Fulfil the oath of allegiance to each and give them their due for Allah will question them about what He asked them to guard.” (Bukhari and Muslim.)
Furthermore, the fundamental principle among Muslims is that no political grouping is permissible unless it is based on the Islamic Aqeedah. Hizb ut Tahrir states in its proposed Draft Constitution for the Khilafah State, which it presents to the Ummah: “Article 21 – Muslims have the right to establish political parties to hold rulers accountable or to assume authority through the Ummah, on the condition that their foundation is the Islamic Aqeedah and that the rulings they adopt are Sharia-based. The establishment of a party does not require any license, and any political grouping based on something other than Islam is prohibited.”
Third: The discussion about a decentralized (federal) system of governance essentially means dividing Sudan into small states, making it easier for colonial powers to control. In Islam, governance is centralized, while administration is decentralized.In the proposed Constitution for the Khilafah State, it is stated in Articles 16 and 17: (Article 16 – The system of governance is a unitary system, not a federal system.) (Article 17 – Governance is centralized, while administration is decentralized.)
The Prophet (saw) emphasized the unity of the state and the prohibition of its division and fragmentation, saying: «إِذَا بُويِعَ لِخَلِيفَتَيْنِ فَاقْتُلُوا الْآخَرَ مِنْهُمَا» “When allegiance is sworn to two caliphs kill the second of them.” (Narrated by Muslim) He (saw) also said: «وَمَنْ بَايَعَ إِمَاماً فَأَعْطَاهُ صَفْقَةَ يَدِهِ وَثَمَرَةَ قَلْبِهِ فَلْيُطِعْهُ إِنْ اسْتَطَاعَ فَإِنْ جَاءَ آخَرُ يُنَازِعُهُ فَاضْرِبُوا عُنُقَ الْآخَرِ»“If anyone swears allegiance to an imam, giving him his hand in ratification and sincere agreement in his heart, he must obey him if he can. Then if another comes and contends with him, cut off that other one’s head.” In another narration: «فَاضْرِبُوهُ بِالسَّيْفِ كَائِناً مَنْ كَانَ» “Strike him with the sword, whoever he be.”
In Conclusion: It is our duty—all of us—to be aware, and then more aware of the colonial kufar’s schemes aimed at fragmenting the country, eliminating what remains of Islamic rulings, and plundering resources through their agents who have chosen to be slaves to them rather than servants of Allah. We must hold the politicians and rulers accountable, restraining them to the truth, and blocking the path to the colonial conspiracies—by hastening to establish Islamic governance under the Khilafah Rashidah on the method of the Prophethood.
[يَا أَيُّهَا الَّذِينَ آمَنُوا اسْتَجِيبُوا لِلَّهِ وَلِلرَّسُولِ إِذَا دَعَاكُمْ لِمَا يُحْيِيكُمْ وَاعْلَمُوا أَنَّ اللَّهَ يَحُولُ بَيْنَ الْمَرْءِ وَقَلْبِهِ وَأَنَّهُ إِلَيْهِ تُحْشَرُونَ]
“O you who have believed, respond to Allah and to the Messenger when he calls you to that which gives you life. And know that Allah intervenes between a man and his heart and that to Him you will be gathered.” [Al-Anfal:24]
