The US-Led Global Capitalist Order, with its International Rulings and Institutions, Will Always Keep Pakistan Enslaved

Hearing the presidential reference on the Reko Diq copper and gold mine project on 2^nd November 2022, Justice Munib Akhtar, desc­ribed the International Centre for the Settlement of Investment Disputes’ (ICSID) $6.5 billion award against Pakistan as a “nuclear bomb,” since it could be taken up anywhere in the world for implementation.

Comment:

On July 12, 2019, the World Bank tribunal slapped a cumulative $6.5bn penalty on Pakistan, while deciding a dispute between the government and Tethyan Copper Com­pany Pty (TCCP), over the huge Reko Diq Mine. The award came after the Mining Authority of Balochistan turned down a TCCP’s application seeking the multimillion-dollar mining lease in the province, following the Supreme Court’s 2013 judgement. A threat of an additional $2-3bn award, in an arbitration pending before the Inter­national Chamber of Commerce, looms large, in case Pakistan failed to strike a deal by 15 December, 2022.Another door for pressure on Pakistan is to be opened by the Foreign Investment in Pakistan (Promotion and Protection) Act (FIPPA) 2022.

It is unusual for the government to ask the Supreme Court to pre-sanctify precisely a commercial deal between a “sovereign” country, Pakistan, and the world's leading mining company, which has the order of the International Center for Settlement of Investment Disputes (ICSID), whose authority is enforceable internationally.

It has become clear that in the current world order, there is no sovereignty for any state, outside of the major powers. So the “national sovereignty” that is considered “sacred” in the present world order is nothing but a delusion. On the one hand, states are allowed to make their own laws, in the name of national sovereignty. However, another set of rulings and laws is imposed on them, in the name of International Law and international institutions such as the ICSID.

International rulings gain supremacy over national law, because states have the right to legislate, due to the democratic system. So laws are made according to the orders of colonialist countries, ensuring the supremacy of international rulings and judgements, as we have seen in the proposed Foreign Investment in Pakistan (Promotion and Protection) Act (FIPPA) 2022.

Therefore, after becoming a member of the United Nations, World Trade Organization (WTO), International Court of Justice, FATF and the IMF, any talk of national sovereignty and true independence is just a sham. The democratic system, international order and global colonialist institutions, are the “nuclear bombs” of our enemies, through which they are enslaving us without using actual weapons.

To achieve real independence, it is mandatory to end the existing world order. That is not possible without the establishment of a Khilafah (Caliphate) on the Method of the Prophethood. The Khilafah is the state whose laws are derived only from the Noble Quran and Prophetic Sunnah. No law of the world can have any sort of supremacy over it.

The Khilafah is the system of government which will unify the Muslim regions and turn their human and natural resources into a great power, after which we will not need to surrender sovereignty for any external capital investment. This is the only way through which we can attain honor, prosperity and the pleasure of Allah (swt).

[وَمَنْ أَوْفَى بِمَا عَاهَدَ عَلَيْهُ اللّٰهَ فَسَيُؤْتِيهِ أَجْراً عَظِيماً]

“and whoever fulfils the covenant that he made with Allah, He will bestow on him a great reward.” [Al-Fath, 48:10].
