Press Release For Whose Benefit is the Members of Hizb ut Tahrir Harassed in Syria and Why Now? (Translated)

On 06/04/2015, Brother Mohammed Ad-Dokhi (Abu Ahmed) and Brother Radhwan Al-Kholi (Abu Osama) were arrested, both are members of Hizb ut Tahrir/Wilayah of Syria. It was against the backdrop of distributing a statement titled "Has Muslim Blood Become Cheap to "Sham Ar-Rasool" Brigade As it Has for the Tyrant of Ash-Sham?!" The statement revealed the assassination attempt of Sheikh Ibrahim An-Najjar (Abu Suhaib) one of the members of Hizb ut Tahrir/Wilayah of Syria in Kafr city of Batna in eastern Ghouta, who chaired a committee of people from the neighborhood to follow through with the case of the two Mujahideen killed at the hands of "Sham Ar-Rasool" Brigade. The statement explained the sanctity of Muslim blood and called the Mujahideen to protect Muslims from the oppression of the tyrant of Ash-Sham. But it seems that this has annoyed the "Army of Islam", and rather than being just to the oppressed, it started to arrest those who distributed the statement; upholding the word of truth and enjoining the good and forbidding the Munkar according to Allah's command and it is a "Fitna" according to the Army of Islam !!.


On 10/04/2015 a mass demonstration took place in Kafr Batna demanding the Army of Islam to release members of the Hizb. The next day, a delegation of Ghouta notables went to the Army of Islam demanding the release of the detainees and they responded to this and released them. On 26/04/2015, the Army of Islam re-arrested the two brothers on one of their check-points in Douma.


O Muslims in Ash-Sham the abode of Islam: It is no secret that Hizb ut Tahrir is a political party whose ideology is Islam; it was established in response to the command of Allah (swt):((وَلْتَكُنْ مِنْكُمْ أُمَّةٌ يَدْعُونَ إِلَى الْخَيْرِ وَيَأْمُرُونَ بِالْمَعْرُوفِ وَيَنْهَوْنَ عَنِ الْمُنْكَرِ وَأُولَئِكَ هُمُ الْمُفْلِحُونَ)) "And let there be [arising] from you a nation inviting to [all that is] good, enjoining what is right and forbidding what is wrong, and those will be the successful" [Al-i-Imran: 104]


We wonder why are there harassment to the party members in the south and the north and in this particular time in which the signs of the entrance of the interim government inside Syrian with the international support are looming in the horizon. These harassments and other acts will not deter the party from adhering to the commands of Allah (swt) to enjoin the good and forbid the evil, we will continue to uphold the truth fearing Allah alone, following the saying of Allah (swt): ((فَاصْدَعْ بِمَا تُؤْمَرُ وَأَعْرِضْ عَنِ الْمُشْرِكِينَ)) "Then declare what you are commanded and turn away from the polytheists" [Al-Hijr:94]

Until Allah (swt) makes Islam prevail by the establishment of the Khilafah "Caliphate" otherwise we shall perish working for it. The Messenger of Allah (saw) said: «أفضل الجهاد كلمة عدل عند سلطان جائر» "The best Jihad is the just word to a tyrant ruler". And He (saw) said: «سيد الشهداء حمزة بن عبد المطلب ورجل قام إلى إمام جائر فأمره ونهاه فقتله» "The master of martyrs is Hamza Ibn Abdul Mutalib and a man who stands up to a tyrant ruler and orders and forbids him (accounts him) and is killed (by the ruler)". We call upon the (Army of Islam) to release the two members, and to fear Allah in the Dawah carriers, and direct their efforts to overthrow the secular system. It is a stone's throw away from them, and to work for the support of this Deen with the sincere workers to establish the guided Khilafah "Caliphate" on its ruins, in response to the command of Allah Almighty:

وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنْزَلَ اللَّهُ إِلَيْكَ فَإِنْ تَوَلَّوْا فَاعْلَمْ أَنَّمَا يُرِيدُ اللَّهُ أَنْ يُصِيبَهُمْ بِبَعْضِ ذُنُوبِهِمْ وَإِنَّ كَثِيرًا مِنَ النَّاسِ لَفَاسِقُونَ

"And judge, [O Muhammad], between them by what Allah has revealed and do not follow their inclinations and beware of them, lest they tempt you away from some of what Allah has revealed to you. And if they turn away - then know that Allah only intends to afflict them with some of their [own] sins. And indeed, many among the people are defiantly disobedient." [Al-Ma'ida: 49]

Regime Treats Jihad against Kaffir Occupation as Terrorism

Speaking at a panel discussion with the Asian Development Bank's President Takehiko Nakao and Indian Finance Secretary Rajiv Mehrishi on 3 May, Finance Minister Ishaq Dar said the security situation in Pakistan was the result of the global menace of terrorism "which travelled from sea to sea and escaped and took refuge in Pakistan". "It is the regional challenge, global fight. It is not only in Pakistan," he said, adding that the international community wanted Pakistan to go after militants and destroy their sanctuaries.

The Raheel-Nawaz regime is again following the American line exactly. America seeks to end the Muslims' deep attachment to Islam, which was developed over centuries of adherence to Islam, fighting in its cause and ruling by it. It is the power of Islam that was the key to the establishment of Pakistan in the first place, forcing a former leading global state, Britain, to end its military occupation of the Indian Subcontinent, never daring to return again. It is the power of Islam that forced another superpower, Soviet Russia, to end its occupation of Afghanistan, in such a severe state of military and economic exhaustion that it led to its eventual and complete collapse. However, now that America has itself occupied the region, the power of Islam is directed against it.

Suppressing Islam in Pakistan is now a matter of survival for the American presence and interests in the region. Using the "National Action Plan" amongst other means, America has mobilized its agents to denounce Jihad as "terrorism" and persecute the sincere mujahideen fighting the American occupation of Afghanistan, using the arrests of miscreants performing sectarian and ethnic violence as a cover to hide her main purpose. America's agents also clamp down on Islamic expression in the media, social media and the political medium, denouncing it as "hate speech", "radicalism" and "Islamism," whilst seizing thousands of sincere Ulema and politicians who call for Jihad against America's occupation of Afghanistan and the return of the Khilafah "Caliphate" to Pakistan.

 

Regime Establishes Friendly Relations with Hostile Nations Like India and America

The Army's top brass accused the Indian intelligence agency RAW on 5 May 2015 of supporting terrorism in Pakistan. An ISPR statement on a meeting of the Corps Com­manders held at the General Headquarters said, "The Conference also took serious notice of RAW's involvement in whipping up terrorism in Pakistan." RAW has quite often been blamed by law-enforcement agencies for being involved in subversive activities in Pakistan, but it is unusual for a corps commanders' conference to directly point fingers at the hostile intelligence outfit.

The Raheel-Nawaz regime has repeatedly asserted that the Indian intelligence is involved in creating chaos in Balochistan. It is also widely known that the American intelligence has been involved in bloodshed throughout the country. Yet, the regime neglects the Islamic command regarding the hostile Kuffar which is to treat them on a war footing. India is occupying Muslim Lands and has adopted a clearly belligerent stance yet the Raheel-Nawaz regime ensures that its subjects are given easy access to Pakistan and the Hindu state establishes missions and other forms of presence.

Only once the Khilafah "Caliphate" returns will the people see serious action to end the foreign incited insecurity. As Hizb ut Tahrir has adopted in its Introduction to the Constitution, in Article 189, "States with whom we do not have treaties, and the actual imperialist states, such as Britain, America and France, and those states that have designs on the State, such as Russia, are legally considered to be belligerent states. All precautions must be taken towards them and it would be wrong to establish diplomatic relations with them." And in the same Article Clause 4 it has stated, "States that are actually belligerent states, such as Israel for example, a state of war must be taken as the basis for all dealings with them. They must be dealt with as if a real war existed between us - irrespective of whether an armistice exists between us or not - and all their subjects are prevented from entering the State."

 

In the Khilafah "Caliphate", Sovereignty is only for Allah (swt) not Human beings

The focus of Monday 3 May 2015's hearing in Supreme Court as reported by Dawn was about whether parliament make fundamental changes in the basic characteristics of the Constitution like replacing Islam being a state religion, as stated in Article 2, with secularism. Clarifying the role, Chief Justice reminded the forum that the Supreme Court had referred the 18th Amendment back to parliament, "The basic structure theory was never accepted by the court and while referring the matter back to the parliament it acknowledged the supremacy of parliament". This clearly explains the supremacy which the parliament enjoys in legislation not only in Pakistan, but in democracies around the world, this authority to legislate not only gives authority to parliament to change the nature of the state, it has made the constitution of Pakistan secular even in its current form. To make this constitution more acceptable to our people and herd them into participating in this system, the successive governments have tried to make a few superficial changes to deceive the people that this secular constitution has been transformed into an Islamic one.

The inclusion of "Qarardad-e-Maqasid" (Objectives Resolution) has not changed the secular structure of the constitution because though it begins with a declaration that "Sovereignty in the whole universe belongs to Allah," in the very next breath it surrenders this sovereignty to the people and grants the legislative assembly of public representatives the right to make laws. Therefore, not a single article of the 280 articles of the constitution refer to the Quran and Sunnah for its evidence. As for the Islamic Ideological Council, we know it has only a limited and advisory role. Its recommendations and resolutions are not binding on the parliamentary members. A similar deception is the establishment of the Federal Shariah Court through Article 203, whereby the constitution has been safeguarded from the review of the Federal Shariah court by Special Provision. Thus democracy can never deliver an Islamic constitution to the Islam loving people of Pakistan or anywhere else in the world. Islam can only be guaranteed when implemented through the Khilafah "Caliphate" which takes the right of legislation from man and keeps it restricted to the Lord of all the World Allah (swt) Alone. As stated by Allah (swt), ((إِنِ الْحُكْمُ إِلاَّ للَّه)) "Indeed the rule is for none but Allah."

 

Lack of Heavy Industry Cripples Pakistan

On 8 May 2015, the Pakistan Bureau of Statistics said that Pakistan's trade gap widened by 11.28 per cent to $17.923 billion during the first ten months of this fiscal year compared to $16.106 bn a year earlier. The surge is an outcome of a fall in export proceeds, whilst imports grew.

The point of grave concern is what we import and what we export, rather than its value, which reveals that the regime is grossly negligent regarding Pakistan's economy. Importing engines, machinery and telecommunications equipment, whilst exporting textiles and sports equipment is not healthy. Although Pakistan has huge material resources, a young, bright and lively population and has been included within the "next eleven" economies in the world regarding its potential, its industry is in a pitiful state, since its creation. The so-called industrial growth of the sixties and seventies was of basic and simple industry, without laying the basis for heavy industry. Since then until now, the IMF and World Bank have overseen further destruction. Growth rate of industry fell from 8.2% in 1980's to 4.8 % for the 1990's and in the latter half of 1990's the growth was only 3.2%. In 1996/7 the growth for industrial sector was minus 0.1%, and was 1.5% in 1999/2000. Private investment fell from 10% to 8% during the 1990's, though foreign ownership of industry has surged, as reflected in the Foreign Direct Investment (FDI) figures. Gross fixed capital formation in private sector in the large-scale manufacturing sector fell continuously over the 1990s, by as much as 60%. And successive rulers facilitated foreign companies in establishing industry, such as extraction plants, refineries and power generation and taking their huge profits abroad, whilst obstructing local private companies through requirements such as obtaining 22 NOCs (No Objection Certificates) to install even a medium size industry. So, it is not surprising today that thousands of industrial units have been declared sick and overall local industrial production is at an all-time low, with foreign multinational companies strengthening their hold on our economy.

From the first day of the return of the Khilafah "Caliphate", the Islamic State will strive to become the leading state, unmatched by any rival, as it was before. Regarding industry, it will have a military focus, which will lead to the rapid development of a heavy industrial base. In its Introduction to the Constitution, Hizb ut Tahrir has adopted Article 74, "The Department of Industry is in charge of all the affairs connected to industry, whether heavy industry such as the manufacturing of engines, machines, vehicles, materials and electrical equipment, or light industry. Similarly, whether the factories are of the public property type or they are included in the private property and have a relationship to the military industry. All types of factories must be established upon the basis of military policy... it is a duty upon the State to manufacture weapons by itself and it is not allowed to depend upon other states, because this allows other states to control it, its will, its weapons and its fighting... This can't be achieved unless the State possesses heavy industry and started to build factories which produce heavy industry, both military and non-military alike."

Speech on Behalf of the Member of the Hizb ut Tahir Media Office in Uzbekistan (Translated)

Despite the ongoing suffering, humiliation and oppression, no power has been able to remove Islam from the hearts of the people in Uzbekistan, in fact, their love of Islam has increased, thus Islam has become the regime's nightmare.

Under the pretext of "fighting extremism", the Uzbek authorities have declared war not only against Islamic movements, but also against all Muslims, taking advantage of what was carried out by their own hands of terrorist acts on February 16, 1999 CE.

The declaration of war on Islam and Muslims is increasing day after day; for example, prisoners are being brutally tortured; they are buried underground, and calcium oxide with water is poured over them and they hang them from their hands and feet, and subject them to rape and sexual humiliation. They suffocate them with plastic bags and gas masks, and are placed in solitary confinement because they pray, or refuse to write a plea to the president.

There are in Uzbekistan's prisons and detention camps, according to various sources, 20,000 Muslims, including approximately 6,000 members of Hizb ut Tahrir, sentenced according to the law of "religious" crimes! These are more vulnerable to brutal torture, which led some of them to madness.

For example, detainee Jamal al-Din Karimov, born in 1977, was sentenced to 18 years in prison under Article 159 of the Criminal Code "working to overthrow the constitutional system of Uzbekistan". Since October 2001, he was transferred between two prisons which are the most horrific in Navoi, in Gesliq village in Karakalpakstan, and the prison in the city of Andijan. In 2003, while Jamaluddin Karimov was in Gesliq, the guards beat his entire body, breaking his arm ... causing him a painful shock which led him to lose his mind.

In Prison 64/71 in Gesliq, where Karimov is still being held, all prisoners suffer from mental illness as a result of their torture. One method of torture used against prisoners is to sodomize them with a truncheon contaminated with AIDS.

The "religiously committed" are tortured in prisons by preventing them from praying, and if they catch them praying, they are tortured physically, and if the detainee tried to defend himself, they punish him again.

Religious prisoners, especially members of Hizb ut Tahrir, are deprived of their liberty at the end of their sentences; and their arrest is renewed on fabricated charges of violating the rules of procedure and disobeying orders. They are not released from prisons and are not included in amnesty except those who agree to the terms such as the condemnation of religious work, or serving with the security forces or the Uzbek intelligence services, or those who are in a highly deteriorated health condition. For example, on February 11, 2015, 16 prisoners were pardoned.

As for the conditions of our sisters in the prisons and detention centers of the despotic regime, they cannot be described without tears. Recently, one of the oppressed sisters wrote a letter of appeal, stating that 7 or 8 staff interrogated one of her friends in the room, and during her interrogation they beat her with sticks, and pulled her by her hair and beat her head against the wall and asked her to write the names of all those who help her financially, after which they raped her using clubs. They had asked another woman the same thing and threatened her that if she does not comply, they will remove all her clothes in front of everyone and then they will drag her in the prison corridors while naked and beat her with clubs, and if she refuses then they will rape her in front of her brother and her children. Notice how these tyrants torture vulnerable women for taking money from someone because of their miserable state, although supporting them is a duty and the State's responsibility, what then would they do to someone who does not recognize the Karimov regime and his criminal gangs?

As for outside the prison, the government prevents the Khimaar in public places, workplaces, and schools, and threatens whoever wears it expulsion from education and dismissal from work.

During the past six months, and in several areas in Uzbekistan, dozens were arrested on fabricated charges. In Ferghana Valley in particular, more than 70 people have been arrested for religious reasons. During interrogation, the security agencies commit the ugliest methods of physical and psychological torture to obtain confessions from suspects! For example, they exposed the wives naked in front of their husbands and threatened to rape them. The families of the defendants are arrested without justification, and they use them as bargain for releasing the family in exchange for their confessions. They used injections and beat children in front of their parents, and electrocuted their bodies through their mouths and hands.

Muslims who seek to live according to Islam are forced to leave the country, and part from their parents, children and families, and to stay away from their homes and businesses.

The severe repression and persecution of the believing Muslims show that the authorities are not only fighting individual people or specific Islamic groups, but are working to destroy the whole of Islam.

One million persons in the intelligence services, internal staff and heads of local gatherings participate in this war on Islam, who are constituted on the grounds of caring for the citizens, and the army, they also form guards in every village or place to maintain security there.

In conclusion, on behalf of the members of Hizb ut Tahrir in Uzbekistan, I tell you that our hearts will not subside until the Khilafah "Caliphate" State on the method of Prophethood returns, and as Prophet Mohammad (saw) said, «... حتى يظهره الله أو أهلك دونه», "...until Allah (swt) makes it victorious, or I perish therein"!

Islam Karimov's Policy

Islam Karimov is considered the de facto President of Uzbekistan since 1989. Because he has been running the government since he was First Secretary of the Communist Party of Uzbekistan in the bygone era of the Soviet Union. Karimov was elected as president of Uzbekistan in December 1991 by 87 percent of the vote at the time.

These elections came after the events of Namangan city, when thousands of people came out demanding to declare Uzbekistan an Islamic state, in which Karimov swore to the people that if elected president he will fulfill their desire, the people believed Karimov and helped him to reach to power.

Year after year passed and Karimov had failed to fulfil his promise. Although Uzbekistan is a nation rich in natural resources, and its fertile land planted with wheat, cotton, corn, and filled with gardens and fruits, but the situation whether economic, technological or other has not improved, and remained the same.

After the resounding fall of the communist dictatorial tyrannical system and the emancipation of the Central Asian countries from the enslavement of the Kremlin, Muslims breathed a sigh of relief. They began to rebuild the mosques of Allah, reconstructing and purifying them from the impurities of alcohol and pork, which filled the houses of Allah during the atheist communist era, all from the people's own expense. They returned to practice their religious rituals after more than 75 years of disruption.

The Uzbek people are one of the most religious peoples of Central Asia, and this is not surprising because they are a people who loved Islam, Uzbekistan gave the Islamic Ummah the gift of great scholars like Bukhari, Tirmidhi, Nasafi, Zamakhshari, and others, may Allah (swt) grant them all mercy.

Indeed at the beginning of Karimov's rule, Muslims were free to practice their religion; women wore the headscarf and those frequenting the mosques increased and Islamic schools opened without problems compared to the communist era.

During that time, Karimov focused on increasing his popularity. In March 1995, Karimov carried out a referendum to stay in power for another term. He received 99 percent, and in December of 2000 was elected for two consecutive terms, and what led to these results is what was carried out by the Uzbek intelligence of planning and carry out the bombings in 1999 and 2004, which became known as "terrorism and Islamic fundamentalism."

The rulers of Uzbekistan did not like to have a religious population; children, men, women, and elderly, so it banned any foreign financial assistance, whether it was to build or renovate mosques or build Islamic schools or any other Dawah activity.

Then the Karimov regime began its frenzied campaign against mosques and imams who do not support the regime, and closed down mosques which do not mention the name of Karimov and his henchmen. They confiscated loudspeakers and prevented the call of prayer (Azan), and began pursuing, kidnapping, imprisoning, torturing and murdering bearded men, Dawah carriers and women wearing the headscarf, and closed down the mosques; in the city of Namangan alone they closed 98 mosques and only 9 mosques remained.

Here we mention some of the crimes and the sins of the tyrant Karimov regime, in order for all to be aware, the people of Uzbekistan and Central Asia and all the Muslims all over the world, and human rights organizations. Perhaps it will motivate them to stop the "Karimov and his henchmen criminal machine" perhaps it will stop them from inventing lies and falsification of facts, and from oppression, violence and deprivation.

In 16/2/1999, a powerful explosion ripped through the Tashkent capital, at the same afternoon Karimov announced that he was the target of this explosion, and hinted that the hands of the Russian intelligence are behind it. Nevertheless, Karimov's desire to strike at the Islamic movements led to the accusation of the Islamic movements that are working to spread Islam, so the pharaoh of the century declared war against Islam and the Muslims who call to Allah (swt), note that the signs of this began a few months prior to these events.

At noon that day, Interior Minister Olmativ announced that Hizb ut Tahrir is behind these bombings, and that its military wing Hezbullah had carried it out, and he stressed that Hizb ut Tahrir plots while the other movements implement.

The oppressive and dictatorial policy of the Karimov regime had angered the people. And this anger increased day after day, because Karimov affixed each vice to the "terrorist" Muslims for the rampant corruption in all parts of the state and nepotism, especially among relatives of the regime's men, and the country's resources were looted and monopolized by the regime's men and their henchmen, and deprived the people at large of their rights.

Even businessmen and farmers did not escape the looting of their money and wealth that they have accumulated with their hard labour was snatched from them unlawfully under false pretenses.

The Andijan events was the straw that broke the camel's back, when 23 businessmen were arrested by the regime, leaving behind a sea of ​​blood and body parts in the streets of Andijan which witnessed the crimes of the tyrant of Uzbekistan, Karimov.  May Allah's Wrath be upon him and may He (swt) prepare a painful punishment for him.

 

Spring 2005

The Ruling regime decided to control businessmen and farmers in the country. The successful and profitable business of the group Akram Yoldchev drew the attention of the regime, especially the National Security Agency.

Akram Yoldchev was sentenced to prison for 17 years, on charges of terrorism and organizing the Tashkent bombings in 1999, because in one of his books "The True Way to Belief" he incites violence and to establish an Islamic state in Uzbekistan as alleged by the regime.

In 10/2/2005 the trial of the 23 businessmen began in Andijan, they were accused of membership in a banned organization "Al-Akramia" and were accused of violating the Constitution and distribution and dissemination of materials that threaten the stability and security of the society, and the creation of an extremist religious organization.

The arrest operation of "Al-Akramia" drew the attention of human rights organizations, which began to study the case. In an interview with "German Wave" on 8/5/2005 a representative of the Human Rights Society of Uzbekistan Talib Yakobov said, "... in all these actions there is a common factor... The defendants are all young businessmen... and under the cover the non-licensed "Al- Akramia" movement which is not of a terrorist nature ... There are hidden material ambitions".

In reality the regime employs embezzlement, looting, and stealing of businessmen and taking over their savings, and this is like the beginning of the thirties of the last century during the communist era. Yakobov added, "The regime pursues those with money ... businessmen." He answered, "The businessmen are not from "Al-Akramia" movement and we are simple believers."

Mahmoud Joon, one of the detainees and a deputy director of the furniture company Torun Production, said: "The National Security Service told him if they did not sign the statement of false confession - that they are members of the "Al-Akramia" movement - then they will rape their wives". Mahmoud Joon said, "They told us if you continue to withstand the torture we will bring your women and.... I could not fathom that, so I signed the paper of false confessions ..."

The relatives, neighbors and friends of the detainees, did not know the reason for their arrests. They began to gather in and around the court; numerous crowds of people came to voice their anger and dissatisfaction with the trial of these young men.

Hizb ut Tahrir in Russia

The Islamic party Hizb ut Tahrir has been working in Russia since the late nineties of the last century, where its call progressed from Central Asia where the party was working there since the eighties. In the nineties millions of Russian Muslims were allowed to practice their Islamic rituals after 70 years of rule by the authoritarian Soviet regime.

The call of Hizb ut Tahrir is widely spread among Muslims in different areas; in the Volga and the North Caucasus, Moscow and others, and many of the Tatars and Muslims from Bashkiria, Dagestan, and Ingushetia, and even Russians have become members of the party and carried the call to their people. The party has a wide presence in Islamic educational institutions in Russia, which is highly respected among preachers and even among muftis.

However, Hizb ut Tahrir activity did not last long as being permitted by the law; with the arrival of Putin's ruling, the authorities have begun to block the party and its call. Individual pursuits that began in 2000 have effectively ended on 14/2/2003 through a decision of the Federal Supreme Court to ban the activity of Hizb ut Tahrir. The trial sessions took place behind closed doors without the participation of the representatives of the party, human rights organizations and the press ... i.e. the court sessions were a formality while the decision was made elsewhere.

Moreover, the court's decision was not known until the authorities began the first arrests of Hizb ut Tahrir members, the first strikes were in Moscow and Bashkortostan where ammunition were hidden in properties of Hizb ut Tahrir's members and then accused of plotting terrorist acts, and they were convicted and sentenced to a long prison term. Recently the first detainees from the party members were released, almost two years ago.

It is worth mentioning that the regime's repression of the members of Hizb ut Tahrir was not known by the public. Many human rights activists, such as Memorial Center, have protested against the illegal repression and persecution, and attempted to challenge the ban, but the timeframe for appeal passed, as the authorities deliberately delayed time until the period allowed for appeal ends. Also some muftis protested in defense of Hizb ut Tahrir, such as the Mufti of the Asian Section of Russia, NaqeeAllah' Ashirōv, they stated formally that the activity of Hizb ut Tahrir does not contradict Islam, and does not include any extremism or terrorism.  Also from the public figures who did not remain silent is the famous Tatar writer Aider Halim and the President of the Tatar People's Assembly, Fawzia Baiarmova, and others.

Since that time, hundreds and perhaps even thousands of Muslims who have a relationship with Hizb ut Tahrir suffer from suppression of the Russian regime. The situation continues to deteriorate to this day, and until the time of writing this report, more than 80 Muslims are in prison on charges of membership or participation in the activities of the Hizb.

If we were to speak of the reasons for banning Hizb ut Tahrir in Russia, there are many aspects; including satisfying Karimov, who has already fought a fierce war against Hizb ut Tahrir. Today this war is clear and obvious led by the KGB regime headed by Putin, who came to power as a result of carrying out the second Chechen war who is already hostile to Islam. The regime is aware that the danger it faces lies in political Islam, due to the large number of Muslims in Russia, which is about 20 million Muslims. They also excel over the non-Muslims in strength of belief that they will achieve their objective, and their population growth rate is high, and the fact that the party is the vanguard of the revival of Islam in Russia, the regime began pursuing it in the Russia war against Islam.

If we review the events of the last decade (from 2005 to 2015) it reveals the following: After the first strike in 2003 the arrests of the members of Hizb ut Tahrir were limited to accusations of extremism, according to Article 282.2 of the Criminal Code (belonging to an extremist organization), and this article has been implemented since 2005 until 2012. The arrests under this article lead to prison sentences of up to three years, which belong to the category of minor crimes. The majority of the members of Hizb ut Tahrir, who were convicted (and many of them have not been convicted initially) under this article despite being punished for the crimes of extremism, and the party was considered as a terrorist organization.

In 2012, the authorities tightened its war against Hizb ut Tahrir due to the following factors:

First - the deteriorating situation in the country, particularly the opposition's attempts to carry out a revolution at the end of 2011 and beginning of 2012 at a time when Putin almost lost power. After Putin had managed to control the situation, he harshly cracked down on all who posed even a minimal threat to the regime, the degree of lawlessness in Russia increased significantly, although in the past security forces were reluctant to carry out certain actions. After 2012, they became bolder; the Kremlin stopped paying attention to the West's opinion to consider so-called human rights. Following the suppression of the liberal opposition, its attention shifted to the uncontrolled Islamic movements, including the Islamic Hizb ut Tahrir.

Secondly - the events in Syria, which began in 2011, and was quickly characterized as Islamic, by the grace of Allah (swt) and through the efforts of members of Hizb ut Tahrir, this made the authorities fear the establishment of the Khilafah "Caliphate" upon the method of Prophethood in Syria and its impact on the 20 million Muslims in Russia.

Third - since the beginning of 2011 Hizb ut Tahrir entered the public arena in Russia with the opening of its Media Office, and its effective political activity began, exposing injustice and repression against members of Hizb ut Tahrir and the Muslims in general, it organized rallies, conferences and seminars.  The Media Office of Hizb ut Tahrir in Russia has played an important role in highlighting the Syrian Revolution in the Russian satellite-media and in the Russian language; therefore the party became the real pioneer of Russian Muslims, and enjoyed a broad support from the people, and held an immense respect and influence among them. The public began to discuss the Hizb, Islam and Khilafah "Caliphate" with the correct view.

As a result of all this, the Russian regime began to intensify its war against Hizb ut Tahrir.

Since 2012, the regime began fabricating criminal cases under Article 278 of the Criminal Code (the seizure of power or maintain it by force), but these charges were absurd and was obvious that they were fabricated charges. In addition the allegation of the "seize power" has led to increased attention to the Hizb; nonetheless these trumped-up charges were taken to court.

  • On 30/7/2014 a Moscow court sentenced four members of Hizb ut Tahrir with harsh prison sentences for periods ranging between 7-11 years under Article 278 with charge of attempt to seize power.

Nevertheless, the absurdity and the weakness of such accusations prompted the authorities to invent new ways to deal with Hizb ut Tahrir; they introduced a new Article to the Russian Criminal Code No. 205.5 (organizing terrorist organization activities)

This occurred as follows:

On 11/03/2013, President Putin signed the law introducing new sets of measures to combat terrorism. There was an introduction of several articles in the criminal law, including Article 205.5 (organization of a terrorist group and participation in it), which stipulates a prison sentence not for two years as in the past, but from 5 to 20 years with a fine payment of up to one million Russian rubles. After 3 months it became evident that expectations were on point, and that these measures were taken in order to fight Hizb ut Tahrir.  This was when Article 205.5 of the Criminal Code was implemented for the first time on 26/2/2014 upon six members of Hizb ut Tahrir in the city Dyurtyuli in Bashkiria. However 20 years in prison was not enough for the authorities, so they amended the Article on 05/05/2014, the first part of it states the penalty of life imprisonment, all these measures taken despite the fact that the reality of the party and its goals and actions have not changed. But the legislation has changed, despite the fact that in all cases there were no crime apparatuses, no place and no victims found. All of this took place in order to blame the Muslims. Thereby membership in Hizb ut Tahrir and the call to Islam does not need evidence. All of this is clear and it is not a secret to anyone.

As a result, there was a contradictory reality in 2014, as some members of the same party are still being tried under the previous Article 282.2, while others are already facing charges under Article 205.5 of the Criminal Code, which maintains a penalty of up to life imprisonment. In 24/07/2014 against the backdrop of the vast campaign, six party members were arrested in St. Petersburg, according to the first part of Article 205.5 (the harshest one) and which is already punishable with a lifetime imprisonment.

In the meantime, the situation is rapidly deteriorating; the accelerating wheel of repression is moving in unimaginable force. The authorities are already carrying out campaigns of wide arrests (as what happened at the beginning of the month of February in Bashkortostan, when they arrested more than 20 members in a single day, each and every one of them is threatened with a five year imprisonment).

It is worth mentioning that all the years of repression accompanied misleading fabrications regarding Hizb ut Tahrir; whether broadcasted directly in press centers from law enforcement agencies, or representatives of the security services among Muslims. The absence of law with regard to Hizb ut Tahrir has paved the way for the media to promote illusions and misleading propaganda; some of them are not aware of such explicit contradictions, and publish only what is receives from the security services,

Others do not dare to tell the truth, and therefore they support the regime's policies against Islam. In many cases, the media is spreading false information, and refuses to refer to the Media Office of Hizb ut Tahrir in Russia. Accordingly, they have conjured up false information about the activities of the party, making law enforcement officials continue with their repression.

After the adoption of the new terrorism laws, the enforcement of the brutal unjust law is undertaken by the courts in various parts of Russia.

The evidence suggests that the new legislation and the decisions of the courts are in line with current federal Supreme Court's decision of 2003; terrorist laws started pursuing terrorist groups.

It should be noted here that those who are in prison on charges of belonging to Hizb ut Tahrir are not all members of the party, some of whom are ordinary Muslims, so that the security services demonstrates to the people that anyone who approaches Hizb ut Tahrir could simply lose his freedom.


As for the Islamic and Muslims Situation in General Matters are as follows:

The Headscarf Ban in Schools and Universities

 

Wearing the Islamic dress was banned fully in schools after a long discussion on this topic. On February 11, 2015 the Russian Federal Supreme Court approved the ban on wearing the headscarf in schools, and has upheld the decision of the District Court of the Republic of Mordovia, which banned "wearing a headscarf - or any religious manifestations in schools," in May 2014 earlier. A similar ban was confirmed in Stavropol, Rostov, Ivanovo and Astrakhan regions.

On 9 July 2013, the Supreme Court in Russia approved the ban on wearing the headscarf in secondary schools in the Stavropol region, and on 15 January 2014, the government of Rostov region adopted a decree issued by the Ministry of Education in the region for the school uniform requirements. One of the points in the document is to ban visits of educational institutions in religious attire.

The governor of Ivanovo region, Mikhail, said, "As long as I am the governor of this region, this will never happen." Governor Alexander Jailkin said, "No discussion. From the first of September, there will be no unusual clothes in schools and educational institutions in this region. Convey this to the representatives of ethnic groups... this is definite and it is not a subject of discussion and those who have a different opinion, there are many other options."

The ban on Muslim women wearing the headscarf, which in Islam is a requirement for women to wear, is contrary to the Constitution of Russia, especially Article 28, which states "Everyone will be guaranteed the freedom of opinion and freedom of religion, including conversion of religion or atheism as individuals or groups and to follow a belief or not to follow any belief and the propagation of the belief and other and acting according to the belief."

Wearing the headscarf is allowed in Chechnya, Dagestan and Tatarstan, i.e. in the Muslim areas where clothing is the Islamic tradition. In areas where Muslims constitute a minority, the headscarf is banned in schools. The authorities want to kill the culture and thus prevent the call to Islam through putting the "Islamic Republics" under siege.

If the secondary educational institutions (schools) were to prohibit the headscarf by law, it would be banned in universities internally according to the law of the University. Similar incidents occurred at least twice in 2014 in the Pirogov Russian National Research Medical University, and I.M. Sechenov First Moscow State Medical University, only because of the community's broad resistance and the Muslim representatives' active role allowed the heads of universities to permit the headscarf.

 

The Problem of Building Mosques

 

In many non-Muslim areas of the country, there is an unofficial ban on the building of mosques. Often Muslims face many obstacles along their way in building a mosque for the first time on land which has none, for example, mosques in Kaliningrad area, Vladivostok, Pyatigorsk, Soraski, and in other areas to obtain a license to build a mosque which requires a contract.

After collecting the necessary paperwork, officials delay the matter by putting many administrative obstacles. Moreover, there is the problem of closing down the existing mosques, and there many such cases. At the same time, such a problem does not exist in the "Islamic Republics", and this indicates that the authorities are struggling to prevent the construction of mosques outside the Muslim areas.

 

The Islamic Culture

 

Different courts in Russia ruled to ban a large number of the fundamental Islamic books, for example, the list of banned literature includes: "Riyadh As-Saliheen", "Fortress of the Muslim", "The Forty Nawawi", "Volumes of Sahih Bukhari", "The Seerah of Ibn Hisham", and others.

The authorities did not succeed in banning the valued Islamic heritage after it noticed the negative reaction by Muslims, they even prohibited the most renowned translation of the meaning of the texts of the Qur'an in the Russian language, describing it as extremist, and this is considered banning of the Qur'an itself.

On 17 September 2013, the Criminal Court upheld the decision of the Prosecutor in Novorossiysk that the book by Almira Guliyev's Transliteration of the Holy Qur'an in the Russian language is an extremist book.

It was only after Muslims organized pickets protesting against the ban of their fundamental Book that the ban was lifted in December 2013, and it should be noted here the role of Hizb ut Tahrir in Russia, where the members of the party were the first to organize public campaigns for the defense of the Qur'an; which lead many of them to be imprisoned with long prison sentences.

 

Islamic Organizations

Russia banned all Islamic organizations, even those far from violence and are non-political, such as the Tablighi Jamaat and Nourgolar group. In April 2008, the Supreme Court considered the Nourgolar group an extremist organization.

In 2009 the Supreme Court of Russia announced the ban on the Tablighi Jamaat and considered it a banned global association on Russian territory and in accordance to the official website of the Federal Prosecutor, the court found that "the structural units of Tablighi Jamaat's activities threaten the ethnic and religious stability in Russian society and the unity of the Russian Federation territory".

Consequently, the members of these groups are being continually harassed and imprisoned, according to Article 282.2 of the Criminal Code (the establishment of an extremist organization). From all this it is clear that Russia sees Islam as a threat, and therefore they are trying to eliminate anything that revives Islam amongst the 20 million Russian Muslims.

Main Conclusions:

  • All measures taken against members of Hizb ut Tahrir are baseless and are politically motivated, and have nothing to do with the party's activities.
  • Russia is implementing a declared domestic policy hostile to Islam. The harassment against members of Hizb ut Tahrir is due to them being the vanguard of the revival and for being the reason in the emergence of political awareness among Russian Muslims.

 

Due to the fact that the Russian authorities do not plan to change its position towards Islam and towards Hizb ut Tahrir, the only thing that can be done today with respect to injustice is an attempt to influence public opinion, but this is impossible if the Russian media is not objective in their coverage of the events, and does not stop its anti-Islam policy.
