The Answer to the Question About the Chapter on the Indication of the Letter "ف" To: Hamid Nasuh (Translated)

Question

Assalamu Alaikum wa Rahmatullah

It is mentioned in your esteemed book Taysir al Wusul ila Ilm al-Usul (Facilitation of Gaining Knowledge in the Legal Methodology) in the research on the evidences of legal conditions (Illah), that the letter "ف" in the Messenger's (saw) saying "ملكت أمرك فاختاري" "You possess your matter so choose" serves as a Illah, because it is a particle of multiplication. Whereas the letter "ف" in the Almighty's saying "فاجلدوا ..." "...So lash" is causal in the restrictive sense, not open to multiplication.

Upon reflection of the two, I could not find the difference.

Please clarify ... May Allah help you to establish His Deen on earth. Wassalamu Alaikum.

Answer

Wa Alaikum Assalam wa Rahmatullahi wa Barakatahu

There are letters in the language that - through their linguistic status, i.e. their expression - serve as a legal condition, such as the letter "ل" and the particle "كي".

The letter "ل" as in the Almighty's saying:

لِئَلاَّ يَكُونَ لِلنَّاسِ عَلَى اللَّهِ حُجَّةٌ بَعْدَ الرُّسُلِ

"so that mankind will have no argument against Allah after the messengers" [An-Nisa: 165]

The particle "كي" as in the Almighty's saying:

كَيْ لا يَكُونَ دُولَةً بَيْنَ الأَغْنِيَاءِ مِنْكُمْ

"so that it will not be a perpetual distribution among the rich from among you." [Al-Hashr: 7]

There are letters that cannot serve as a legal condition through their linguistic status, i.e. their expression, but through their implicit meaning, i.e. their indication. From these letter is "ف." It does not serve as a legal condition by way of its expressed meaning, i.e. its linguistic status. The Arabs have not determined it as a legal condition. Rather it comes as particle that expresses the plural, or an order, or an immediate consequence or a linguistic condition serving for an indicated legal causation or a linguistic condition serving for an indicated non-legal causation.

If it comes as a particle for a plural, or for an order, or an immediate consequence, then there occurs no confusion as to its understanding. The problem arises when it comes for causation and expounding, i.e. what comes after it is a cause of what came before it. In other words: It expounds what came before it. This is where confusion arises as to determine whether the particle is a mere cause or a legal condition. Of course what is meant here is technical term in the methodology of jurisprudence (Usul al-Fiqh).

To distinguish between the two, there are characteristics of the legal condition and the non-legal cause. Hence it is looked at the implied meaning of the usage of the "ف", i.e. its necessary indication. If the characteristics of the legal condition (Illah) are applicable, then it serves for legal qualification. But if the characteristics of a non-legal cause are applicable to it, then it serves merely for causation.

As to not dive too deep into the characteristics of the legal condition (Illah) and the non-legal cause (Sabab) and the difference between the two, we will suffice with a simple difference that is open to more detail. From this difference it can be deduced whether the "ف" with its indicated meaning hints at a legal condition or a mere cause. This difference is the association of the legal provision (Hukm) with the issue at hand. If an association exists between the legal provision and the issue, then the "ف" denotes a legal condition. On the other hand, if the issue comes before the legal provision, meaning that it precedes it without associating with it, then the "ف" denotes a mere cause.
In light of this, your question on the confusion of the difference between "ملكت أمرك فاختاري" "You possess your matter so choose" and

الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ

"The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashes" [An-Nur: 2]

...has to be studied. Before I begin, I will clarify to you the meaning of "You possess your matter so choose". This saying is contained in a number of books on the Islamic Methodology of Jurisprudence (Usul), such as Al-Amidi's Al-Ihkam fi Usul al-Ahkam or Kamal Bin Muhammad Al-Ma'ruf's (better known as Bin Al-Hamam) Fath al-Qadeer. The saying, according to the Scholars of Usul, is a reference to the Hadeeth of the Prophet (saw) where he gave Bareerah a choice. Bareerah was married to a slave, when she herself was released and therefore became free, the Prophet (saw) let her choose whether she would remain married to her husband or not, because she became a free woman that owns her choice. The Hadeeth was reported by al-Bukhari and Muslim.

Al-Bukhari reported from Aisha (ra), who said: "I bought Bareerah, and then set her free. The Prophet (saw) called her

«فَخَيَّرَهَا مِنْ زَوْجِهَا، فَقَالَتْ: لَوْ أَعْطَانِي كَذَا وَكَذَا مَا ثَبَتُّ عِنْدَهُ، فَاخْتَارَتْ نَفْسَهَا»

"He gave her the choice as to her husband. She said: ‘If he gave me such and such, I would not stay with him.' So she chose herself."

Muslim reported from Aisha (ra) that she bought Bareerah from some people of the Ansar...

«وَخَيَّرَهَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَكَانَ زَوْجُهَا عَبْدًا»

"The Messenger of Allah (saw) gave her the choice and her husband was a slave."

So now that the meaning of the first example has been clarified and as the meaning of the second example is clear, let us have a further look at the two examples:

1. The first example demonstrates the choice of possessing oneself. Once she was liberated, she possessed the choice over her matter. Therefore, there is an association with the legal provision: As soon as she was liberated, she owned the right of choice immediately. Hence we say that the "ف" indicates an Illha, for the association between the legal provision and the issue at hand. This is a characteristic of the Illah.

2. As for the second example, adultery is not associated with lashing, rather it precedes it. Hence we say that the "ف" serves as a cause, because the issue precedes the legal provision. Adultery precedes lashing, as is the case with any cause. Another example is the Hadeeth reported by al-Baihaqiy in his Sunan al-Kubra from Khabbab Bin al-Aratt, who said: "We complained to the Messenger of Allah (saw) about the severe heat of the sun, He did not complain and said:

«إِذَا زَالَتِ الشَّمْسُ فَصَلُّوا»

"If the sun recedes, then pray."

Here the "ف" indicates a cause, meaning that the recession of the sun is the cause for prayer. It is obvious that the recession of the sun precedes prayer.

Based on this, if someone is confused over the indication of the letter "ف" - whether its indicated meaning hints at a legal condition or at a cause - he can have a look at the association between legal provision and the underlying issue. If the two are associated, then it is a legal condition (Illah), but if the legal provision follows the issue, then it is a cause. Of course this pertains to the chapter on the indication of the letter "ف", but not to the other varieties of the legal condition (Illah).

The Answer to the Question Is there an educational curriculum by Hizb ut Tahrir? To: Dora ash-Sham (Translated)

Question

Assalamu Alaikum wa Rahmatullahi wa Barakatuh,

I'm not from the Hizb, but I have a request, after your permission.

You have an educational system, programs and others which I read and I liked.

Is there a comprehensive curriculum for all school stages for all the Shariah sciences, and other sciences, to be studied in the liberated areas in ash-Sham, for example, or in any place where there is freedom of education, especially in these circumstances where everyone whether having a goal or thought, or not, wants to open a private school... I wonder how this generation will be founded; Allah is for them and us.

I thought of the idea to asking everyone in all Islamic countries who has the ability to write a curriculum and is protective over his children from being be brought up by others to contribute in the writing of a comprehensive curriculum.

But it came to my mind that if you have a curriculum, then why waste time in writing one, instead I should only complete what you have accomplished and I start with my relatives and beloved. May Allah reward you all the best if you answer or not.

Yes, we have a curriculum, but it needs schools and teachers to teach it. As well as it needs an authority to implement it on the basis of the Shariah laws, and to be recognized as a school certificate so that the student can complete the academic levels. All of this requires a State that rules by Islam and acknowledges this approach in education. This power does not exist now, so how can you teach it and where? After all, we are working hard to establish the Islamic state, the Khilafah "Caliphate", which implements the education curriculum by the ruling of Shariah, and Allah willing, this may be soon.

In conclusion, May Allah reward you for your concern and interest.

Press Release Islamic Organizations: US, Australia and Singapore are Enemies for Indonesia

The former Minister of Social Affairs, Mr Bachtiar Chamsyah justified Hizb ut Tahrir / Indonesia's opinion that the embassies of the United States and Australia became a spy nest in Jakarta. Furthermore, he affirmed that Susilo Bambang Yudhoyono, the President provides ease for the US to expand and enlarge its embassy in Jakarta. He stressed that the government was unable to protect the country from the foreign intelligence activities.


Chamsyah said all that, during the conference that was held by Hizb ut Tahrir / Indonesia together with Islamic Organizations, in the Media Office of Hizb ut Tahrir in Indonesia, on Friday 29/11/2013.


Attending the conference included Abu Deedat (FAKTA); Mashadi (VoA Islam); Zulkifli (al-Ittihadiyah); Fahrurizal Fan (LAki-45); Hemi M Burin (Muhamadiyah); Achmad Michdan (TPM); Muhammad Rahmat Kurnia (Hizb ut Tahrir / Indonesia) and some of the others. In the last statement, the most prominent of all, was that US, Australia and Singapore are enemies for Indonesia.

Inside America's secret 'bomb library' housing 100,000 IEDs from Afghanistan and Iraq

It's a nondescript warehouse on the outskirts of Washington D.C., but hidden inside are the remains of 100,000 explosives specifically designed to harm U.S. troops. America's secret 'bomb library' holds many of the improvised explosive devices (IEDs) which have killed hundreds of military personnel in Iraq and Afghanistan after the 9/11 attacks. They've been collected to help identify individual bomb makers and to develop high-tech responses. The secret FBI facility stores in cardboard boxes the ball bearings, shrapnel, wires, circuit boards, melted cell phones and cordless base stations which were turned into deadly weapons .In Afghanistan, IEDs have killed 954 U.S. troops over the past twelve years of war. In Iraq, 2,207 Americans were killed by roadside bombs. Tens of thousands were wounded. According to ABC News' special report, each IED collected is prioritized by specialized military units in Afghanistan and formerly in Iraq. A code red item must be examined, photographed and checked for fingerprints or DNA within five days. Amber cases have to be processed in 30 days and green packages are considered low-priority. Each IED has its own computer case file, which states the location and date it was detonated or located and if there were any casualties. The IED packages are piled into 3,500 stacked into five-foot-tall white boxes in the FBI warehouse. About 800 IEDs are delivered each month from Afghanistan and about 20 other countries. Angolan Authorities Destroying Mosques

Muslim leaders in Angola say the government has shut down or destroyed dozens of mosques over the past few months, with little or no explanation. An Angolan newspaper quotes David Alberto Já, president of the Islamic Community of Angola, as saying a total of 60 mosques have been shut down, mostly outside the capital, Luanda. In an interview Tuesday with VOA, the community group's vice president, David Fungula, described the closures as "religious persecution," and said he will not stop praying even if all the mosques in Angola are closed. The spokesman of Angola's national police, Aristophanes dos Santos, recently said he is unaware of any government order to shut down and destroy mosques, and denied the state was persecuting Muslims. However, VOA recently obtained a government document telling officials to demolish the "Zango 1" Mosque in Viana Luanda province, east of the capital. The order said the mosque must be torn down because it was built without authorization. VOA has also seen a video showing the total destruction of a mosque in the town of Saurimo. Only a small percentage of Angola's 18 million people are Muslim. Most Angolans are Christians or follow indigenous religions. [Source: Voice of America]

CIA Station Chief Exposed in Pakistan

The political party of the former cricket star Imran Khan on Wednesday identified a man it described as the C.I.A.'s top spy in Pakistan, in an escalation of Mr. Khan's campaign to end American drone strikes in the country. In a letter to the Pakistani police, Mr. Khan's Information Secretary, Shireen Mazari, accused the C.I.A. director, John O. Brennan, along with a man identified as the agency's Islamabad station chief, of "committing murder and waging war against Pakistan." In Washington, a C.I.A. spokesman declined to comment on the case. Ms. Mazari demanded that the authorities prevent the station chief, whose identity has not yet been confirmed, from leaving the country so that he could face prosecution in a Pakistani court. In her letter on Wednesday, Ms. Mazari claimed that the station chief did not enjoy diplomatic immunity, and suggested that if interrogated by the police he might divulge the names of the pilots who fly the drones. Since the escalation of the C.I.A.'s drone war in Pakistan in 2008, the Islamabad station has grown to become one of the spy agency's largest outposts in the world. The agency's expansion in Pakistan has been an irritant to America's relations with Pakistan. The influence of the C.I.A.'s Islamabad station chief has sometimes eclipsed even that of the American ambassador in Pakistan. A previous station chief clashed repeatedly in 2011 with Cameron Munter, the ambassador at the time, over the intensity of the drone campaign. Anti-Veil Drive Sows Tension in Xinjiang

A Chinese government worker in the ancient Silk Road oasis of Kashgar beckons two women to her street side stand and logs their details under the gaze of a surveillance camera. Their offence: wearing veils. The "Project Beauty" campaign aims to discourage women from covering their faces -- a religious practice for Muslim Uighurs, the largest ethnic group in China's Xinjiang region -- in an attempt to improve security. But critics warn the effort could sow resentment and backfire instead. "We need to hold onto our traditions and they should understand that," said a 25-year-old woman who has been registered twice. Offenders were made to watch a film about the joys of exposing their faces, she added, speaking behind a white crocheted covering. "The movie doesn't change a lot of people's minds," she said, like others declining to be named. Xinjiang, a vast area bordering Pakistan and Central Asia in China's far west, beyond the furthest reaches of the Great Wall, has followed Islam for centuries. It came under Chinese control most recently during the Qing dynasty in the late 1800s. Kashgar residents say veil restrictions sparked at least one deadly conflict this year near the city, where 90 per cent of the area's 3.3 million residents are Uighur. "For the Chinese government the causal process is: the Islamic extremists ask for independence, ask for separatism, then that's why they set very strict limits on Uighurs' religious activities," said Shan Wei, a political scientist at the National University of Singapore. Policies to stop them covering their faces, and to a lesser extent their hair, are not publicised. City authorities declined to comment and Xinjiang officials could not be reached. But "Project Beauty" stands could be seen around the city, and a tailor said campaign staff had instructed him not to make the full-length robes often worn with face coverings.
