Is it permissible for a Muslim to subscribe to social insurance?

Answer

Wa Alaikum Assalaam wa Rahmatullahi wa Barakatahu

The participation in the social insurance, which obliged by the state on its employees and the workers in the private sector.
This is permissible for a worker or an employee because it is deducted from his salary from the state or the private sector. They take a part and the employer takes another part and the state or the employer is responsible for the administration. So this is permissible, because it is a compensation of the deducted part of the workers salary, even if the employer added another part, all of this is permissible because it is part of the worker's salary.

However if you, instead of workers in the public sector or in the private sector where the employer deducts part of their salary, are referring to private institutions that establish social security, they are different. Private institutions that encourage people who want to participate, to pay monthly dues, and we treat him if he gets sick... This type is not permissible, because engaging in such a contract is unknown, because it is unknown when disease comes or if it is severe or mild, or... and or... so this contract is invalid and is not permitted.

The Answer to the Question About the Impurity of Animal Urine and Dung To: Abu Omar Nassar (Translated)

Question

Assalamu Alaikum wa Rahamatullahi wa Barakatahu

Our respected Sheikh, it says in the Hadeeth of Anas Bin Malik:

قدم على رسولِ اللهِ صلَّى اللهُ عليه وسلَّمَ قومٌ من عُكْلٍ أو عُرَينةَ. فاجتَوُا المدينةَ. فأمر لهم رسولُ اللهِ صلَّى اللهُ عليه وسلَّمَ بلقاحٍ. وأمرهم أن يشربوا من أبوالِها وألبانِها

"The Messenger of Allah (saw) was approached by a people from ‘Ukl or ‘Uraynah. They were residing in al-Madinah. Hence the Messenger of Allah (saw) ordered them a cure. He ordered them to drink from its urine and milk." [Sahih Muslim].

We have adopted the impurity of urine and the absolute forbearance of utilizing impurity, whether animal urine or dung, and whether it is an animal whose meat is eaten or not.

The evidence of the prohibition of its utilization came in the Hadeeth of the Prophet (saw) on Istinja' (purification after defecation) (it is impure), and is found with Ibn Khuzaymah with an addition (it is impure, it is a donkey's dung). I read in Ash-Shawkaani's Neel Al-Awtar, quoting at-Tamimi, that dung (rawth) is specifically what comes from horses, mules and donkeys.

Through combination of the two Ahadeeth, we find that the dung of animals, whose consumption is permissible, can be utilized, e.g. in fertilizing crops. Please advise us, Barakallahu Feekum!

Answer

Wa Alaikum Assalam wa Rahmatullahi wa Barakatahu.

1. As for the impurity of animal urine and dung:
There is no dispute over their impurity if the animal is prohibited from consumption. As for the animal whose consumption is permissible, there exists a difference of opinion.

The most preponderant is that their utilization is not permissible except for medication. It is permissible although undesirable (Makruh), as shown later. As long as it is impure, than it cannot be utilized. Muslim narrated from Ibn Abbas, who said: "‘Umar was informed that Samarah sold wine, so he said: ‘May Allah destroy Samarah. Does he not know that the Messenger of Allah (saw) said: لَعَنَ اللهُ الْيَهُودَ، حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ، فَجَمَلُوهَا، فَبَاعُوهَا "Allah cursed the Jews. Grease was prohibited to them, so they cooked it and sold it."

Therefore utilization of impurity is Haram.

2. From the evidence on the impurity of urine:

- Al-Bukhaari reported in his Saheeh from Anas Bin Malik, who said: "A Bedouin came and urinated in the corner of the mosque, therefore the people rebuked him. «فَنَهَاهُمُ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَلَمَّا قَضَى بَوْلَهُ أَمَرَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِذَنُوبٍ مِنْ مَاءٍ فَأُهْرِيقَ عَلَيْهِ» "The Prophet (saw) forbade them. So when he finished urinating, the Prophet (saw) ordered vessels of water which were spilled out over it."

- Al-Bukhaari reported in his Saheeh from Ibn Abbas, who said: "The Prophet (saw) passed by two graves, he said: إِنَّهُمَا لَيُعَذَّبَانِ، وَمَا يُعَذَّبَانِ فِي كَبِيرٍ، أَمَّا أَحَدُهُمَا فَكَانَ لاَ يَسْتَتِرُ مِنَ البَوْلِ، وَأَمَّا الآخَرُ فَكَانَ يَمْشِي بِالنَّمِيمَةِ "They are both tortured, but not for a major sins. One of them did not cleanse himself from urine and the other used to practice slander."

- Ad-Daaraqtani reported from Anas, who said: "The Messenger of Allah (saw) said: «تَنَزَّهُوا مِنَ الْبَوْلِ فَإِنَّ عَامَّةَ عَذَابِ الْقَبْرِ مِنْهُ» "Rid yourselves from urine, the majority of torment in the grave comes from it."

Urine, whether from human or animal, has one reality. The evidence on the impurity of urine applies to it. Hence any urine is impure, whether from humans or animals, whose meat is consumed or not consumed. The reality of urine is a single one.

- As for the Hadeeth of Al-Bukhari from Anas Bin Malik, who said: "People came from ‘Ukl or ‘Uraynah and resided in al-Madinah. فَأَمَرَهُمُ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، بِلِقَاحٍ، وَأَنْ يَشْرَبُوا مِنْ أَبْوَالِهَا وَأَلْبَانِهَا "Then the Prophet (saw) ordered them with a cure, to drink from their urine and milk."
This came on the subject of medicine, and combining it with the Hadeeth of Ibn Majah on medication through alcohol, which says:

Ibn Majah reported from Tariq Bin Suwayd al-Hadrmaiy, who said: "I said: ‘Oh Messenger of Allah, on our land we have grapes which we squeeze and then drink from it? He said: "No." So I got back to him and said: "We use it to heal the ill." He said:  «إِنَّ ذَلِكَ لَيْسَ بِشِفَاءٍ، وَلَكِنَّهُ دَاءٌ»

"This is not healing, but disease."

It becomes clear that the prohibition of medication through impure substances is not absolute, therefore it is undesirable (Makruh). Medication through drinking of urine is permissible but undesirable. This does not mean that the substance is not impure, rather it is permissible for medication, though undesirable.

3. From the evidence on the impurity of dung:

- Al-Bukhaari reported in his Saheeh from Abdullah, who said: أَتَى النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الغَائِطَ فَأَمَرَنِي أَنْ آتِيَهُ بِثَلاَثَةِ أَحْجَارٍ، فَوَجَدْتُ حَجَرَيْنِ، وَالتَمَسْتُ الثَّالِثَ فَلَمْ أَجِدْهُ، فَأَخَذْتُ رَوْثَةً فَأَتَيْتُهُ بِهَا، فَأَخَذَ الحَجَرَيْنِ وَأَلْقَى الرَّوْثَةَ» وَقَالَ: هَذَا رِكْسٌ "The Prophet (saw) had to defecate. He ordered me to bring him three stones. Then I found two stones, I sought the third but could not find it. I found dung and brought it to him. He took the two stones and threw the dung away." He said: "This is Raks." Al-Raks is Najasah (impurity).

Concerning your statement that dung (Rawth) is only called what comes out of the animal that is not consumed, and that you found with Ibn Khuzaymah the addition "It is impure, it is a donkey's dung": Al- Bukhari and all other possessors of Sunan such as Ahmad, An-Nasa'i, At-Tirmidhi , At-Tabarani, Ad-Daaraqtani, Al-Bayhaqi, Al-Bazzar and Abu Yu'la, none of them mentions this addition "It is a donkey's dung". I found with Ibn Khuzaymah the following transmission: From Abu Hurayrah from the Prophet (saw), who said: إِنَّمَا أَنَا لَكُمْ مِثْلُ الْوَالِدِ لِوَلَدِهِ، فَلَا يَسْتَقْبِلْ أَحَدُكُمُ الْقِبْلَةَ وَلَا يَسْتَدْبِرْهَا - يَعْنِي فِي الْغَائِطِ - وَلَا يَسْتَنْجِ بِدُونِ ثَلَاثَةِ أَحْجَارٍ لَيْسَ فِيهَا رَوْثٌ وَلَا رِمَّةٌ "I am to you as the father to his son. No one shall take the direction of the Qibla - in defecation - and purify himself without three stones, free from dung or carrion." Its chain of transmission is Hasan.

However, as we have said for urine, the reality of dung is one, whether the animal is for consumption or not. Therefore it is all subject to the same legal provision. Just as the dung of donkeys is impure, the dung of cows is impure. All dung is impure, whether from an animal for consumption or not.

This is what I find to be preponderant. I say "what I find to be most likely to be correct" because there are statements that make an exception of impurity for urine and dung of animals that are consumed.

Geneva II Conference: There has to be an Explicit Declaration that Anyone who Accepts to Participate in it in any Form is an Agent of the West and a Traitor to the Muslims (Translated)

On 25/11/2013 the Secretary-General of the United Nations, Ban Ki-moon, declared that the Geneva II Conference will be held on 22/01/2014. He said: "We have a clear goal, which is the full implementation of the Geneva Statement issued in Geneva on 30/06/2012, and the establishment of an inclusive transitional rule, built on mutual agreement (between the parties to the conflict), and with full executive powers, including military and security entities." The U.S. Secretary of State, John Kerry, whose country has been running the actions around the Geneva Conference and its secret and overt siblings for months, has welcomed to "seek to hold a conference for peace in Syria", which he described as "the best opportunity" to form a new transitional government in the troubled country and take it out of its crisis. The National Coalition had announced its agreement to attend earlier this month, if a number of conditions set by them were approved. America's Lakhdar, the UN and Arab envoy to Syria, reassured on the same day that the Geneva II Conference "will begin without preconditions". It is noteworthy that there is still a dispute over who will represent the Syrian opposition in the conference.

America wants to ensure that from behind this conference, power is safely transitioned to it through a "governing transitional body which enjoys full executive powers, including military and security entities". This is the fundamental clause from the Geneva I Conference, and it will be the main clause in the Geneva II Conference, to which the coalition has agreed beforehand. To safeguard this point from their perspective, it is necessary to eliminate the overwhelming Islamic Project by striking the "Takfiris" and "Extremists" to get rid of the Islamic project, which has increasingly swept the popular arena, as to be decided in the Conference. This is what made America accelerate in holding the conference, before the Islamic Project represented in the Khilafah "Caliphate" can outpace their sectarian project of the region, known as America's project for a new Middle East. Iraq was a first "model" in this project, and Syria is going to be the second model, while America has already extended its rope to drag Syria along. To achieve this, an American formulated international intervention is not farfetched, to implement the solution of Geneva II, so as to ensure the control over the areas of conflict, and to ensure the elimination of the Islamic Project, and then to ensure that the transition of power takes place according to the American project. The rest of what is being said of details, such as securing humanitarian passageways, providing the nutritional needs, releasing detainees and even demanding the ouster of "Chemical Bashar", these are subordinate problems, no matter how hard they try to enlarge them, which can be overcome.

Oh Muslims Rebelling in Ash-Sham, the land of Goodness:

Hizb ut Tahrir has already sent down many leaflets, denoting the gravity of such a conference, reminding that "The Geneva II Conference is a Conspiratorial, Treacherous, Submissive American Conference that must be rejected under all Circumstances. Participation is prohibited by the Shar'ia, just as Silence around its Holding" and that "America Remains Insistent on Holding the Geneva II Conference. Beware of it, and Beware of its Envoy Brahimi, and Beware of its Agent, the National Coalition" and "Finally, the Coalition announced its Bow to Ford all the way down to their Feet. Whereas their Bow before only slightly Exceeded the Limits of their Knees!"

The position on the Geneva II Conference should be solid, evident, without disguise and unambiguous. Therefore all the Muslims in Syria, whom the Coalition claims to represent, have to declare their rejection of the conference, and their lack of acknowledgment of the decisions that will be approved of at the conference, as well as the rejection of the Coalition and that it does not represent them and has no popular extension. The militant groups have already announced that acceptance of participation in the conference is a treacherous action. They must complete this position by explicitly declaring that the Coalition is a creation of the West, especially America, which represents only those who founded it.

Oh Muslims:

The conflict in Syria ash-Sham is now a conflict of civilizations, between capitalism and Islam. All of us feel the help of Allah Almighty for the Muslims in this conflict, who were able to stand in the face of an unprecedented international conspiracy. This is what should motivate them to increase their commitment to what Allah commands, so that His help for us will be complete, and our victory from the Strong, the Glorious will be undiminished. Allah Almighty grants victory to those who give victory to him honestly and sincerely. This requires that everyone from the general Muslims, their scholars, their nobles and the people of power head to support those working to establish a Khilafah "Caliphate". Hizb ut Tahrir continues reminding you of the method of the Messenger of Allah (saw) as the only method for its establishment. The Almighty said:

((مَنْ كَانَ يُرِيدُ الْعِزَّةَ فَلِلَّهِ الْعِزَّةُ جَمِيعًا إِلَيْهِ يَصْعَدُ الْكَلِمُ الطَّيِّبُ وَالْعَمَلُ الصَّالِحُ يَرْفَعُهُ وَالَّذِينَ يَمْكُرُونَ السَّيِّئَاتِ لَهُمْ عَذَابٌ شَدِيدٌ وَمَكْرُ أُولَئِكَ هُوَ يَبُورُ))

"Whoever desires honor [through power] - then to Allah belongs all honor. To Him ascends good speech, and righteous work raises it. But they who plot evil deeds will have a severe punishment, and the plotting of those - it will perish." [Fatir: 10]

Hizb ut Tahrir is a political party whose ideology is Islam, so politics is its work and Islam is its ideology. It works within the Ummah and together with it to restore the Islamic way of life with the establishment of the second Righteous Khilafah "Caliphate" on the method of the Prophethood, by the method that the Messenger (saw) followed when he cared for the affairs of the people by showing Islam's solutions to life's problems and replaced the rulers by intellectual and political struggle.

Hizb ut Tahrir has worked in most of the Islamic lands for the past 60 years, calling to Allah Almighty with honest words and encountering any justification with justification. It does not adopt material actions with the use of force and it does not have a military wing, and there has not been a single incident to prove otherwise. It has well known official media offices and official spokespersons that clearly convey its political ideas and opinions.

Therefore we are surprised that some accredit to us speech or fatwas outside the context of what we have clarified, which were perhaps said by individuals who do not follow the Hizb. The issue does not concern us, and the Hizb's method in exposing the issues of the Ummah is known far and wide. From the day of its establishment the Hizb's struggle has only been against the Disbelievers (Kuffar), and we have never criticized or defamed any Islamic Jihadist party or faction. In conclusion we say to those who made allegations against us: Do not forget the saying of the Messenger (saw):


«البَيِّنَةُ عَلَى المُدَّعِي، وَاليَمِينُ عَلَى المُدَّعَى عَلَيْهِ»


"Proof is on the accuser, and an oath is on the accused."
