America's Soviet Moment

The US Senate Intelligence Committee has released its summary of the much-anticipated report into the CIA interrogation programs established by US spy chiefs after 9/11. The full report, which many senators wanted classified is 6,000 pages long and only a summary of 525 pages has been unclassified. The report took five years to produce and is based on more than 6 million internal agency documents.

The summary report effectively exposes the CIA and lays blame completely on the spy agency for torturing detainees (not prisoners) in order to gain cooperation. It confirms the agency carried out a program with contractors in secret prisons across the globe in the years after 9/11. It also confirms the horrific and brutal details of torture techniques used by the agency. These included detainees being deprived of sleep for over a hundred hours, including a case where detainee Abu Zubaydah was confined to a coffin-sized box for a total of 266 hours. He was kept in an even smaller box for 29 hours. Techniques such as Waterboarding and rectal hydration were routinely used to break down detainees. Most of these detainees have never been put on trial or been found guilty of any crime.

Whilst much of the world has reacted in shock and horror and as details continue to emerge of some of the most brutal torture imaginable, it is important this is this all placed into context and to not get affected by the political posturing. Former CIA heads and intelligence officers are already attempting to rebut the report and provide answers and justifications for what they did. Much of the blame is being labelled squarely on the CIA and it is likely the classified elements of the report would implicate many others, countries and officials.

The context of these torture programs was the climate after the 9/11 attacks. On the evening of September 11 2001, President George W Bush laid out unequivocally the position of the US and the ideological nature of the attack, he said, "Today, our fellow citizens, our way of life, our very freedom came under attack in a series of deliberate and deadly terrorist acts. America was targeted for attack because we're the brightest beacon for freedom and opportunity in the world." Then on the 2006 anniversary of 9/11, Bush confirmed once again the struggle the US was engaged in: "...we are engaged in a global war against an enemy that threatens all civilized nations. And today the civilized world stands together to defend our freedom." Much of the US public was in shock as the Twin Towers collapsed and the enemy and those that harboured them needed to be pursued to the ends of the world, by any means necessary. The fear and panic was the justification for expanding torture (termed advanced interrogation measures), US administration officials believed the brutal methods were necessary to understand the threat against the US, even though it is a widely regarded fact that torture does not produce reliable intelligence. In fact the Senate report makes it clear that, the torture programme produced negligible results and the means of the programme were not justified by its paltry results.

In 2010 George W Bush, speaking with NBC News reiterated that "using those techniques saved lives. My job was to protect America." Former Vice President Dick Cheney laid out what really happened. "What I keep hearing out there is they portray this as a rogue operation and the agency was way out of bounds and then they lied about it. I think that's all a bunch of hooey. The program was authorized. The agency did not want to proceed without authorization, and it was also reviewed legally by the Justice Department before they undertook the program." Cheney also said the conclusion that the CIA misled the White House about its interrogation techniques "is just a crock." The Senate report blames the CIA for everything and even paints the picture that the Senate was misled, the report even states the CIA was much harsher than it represented to policymakers. But the reality is America's global programme of rendition, secret prisons, black prisons, was authorised and justified at the highest levels.

In 2004, the revelations of prisoner abuse at the Abu Ghraib prison in Iraq at the hands of U.S. military personnel garnered widespread coverage by domestic and international media. Images of military police harassing and violating prisoners were circulated, sparking significant controversy over whether the U.S. government employed torture against its enemy combatants, a stark violation of human rights for many as well as an infringement of the Geneva Conventions. Though the media focused on the actions of the military police, rather than interrogators, the revelations quickly led to further inquiries and deep scrutiny over the interrogation practices conducted at the prison and across the intelligence community.

In hindsight the 2004 revelations of prisoner abuse at the Abu Ghraib Prison in Iraq at the hands of the US military was just the tip of the iceberg.

There are three key arguments US officials have used for the last decade to justify the torture programme, which the Senate report exposed.

Actionable Intelligence - This is any piece of information, by itself or as a factor in analysis that military commanders or policymakers can use in making decisions. As the US was in a global war of terror interrogating actionable intelligence from detainees would stop other pending attacks. The Senate report exposed this and concluded: "none of 20 cases of counterterrorism "successes" attributed to the techniques led to unique or otherwise unavailable intelligence."

Ticking Time Bomb - This was the widely used justification for torture, especially in the case of Khalid Sheikh Muhammad, who the US considered the principal architect of 9/11. As the perpetrator of 9/11 he could disclose information on other imminent attacks, if tortured. On the floor of the US Senate on 9 December, Democratic Senator Dianne Feinstein said that Senate investigators never found a single instance of it happening. "At no time did the CIA's coercive interrogation techniques lead to the collection of intelligence on an imminent threat that many believe was the justification for the use of these techniques. The Committee never found an example of this hypothetical ticking time bomb scenario." The supposed ‘ticking bomb' scenarios initially used to justify the use of torture, became sustained and routine torture of detainees in the off chance that some useful intelligence may come to light.

Lives Saved - Whether it was senators, administration officials or intelligence agents, they all justified torture on the basis it saved US lives. It said the CIA justified its use of such techniques with "inaccurate claims of their effectiveness," including examples of thwarted plots in Britain such as a plan by 9/11 mastermind Khalid Sheikh Mohammed to hijack planes and attack Heathrow airport and Canary Wharf.The Senate report however highlighted the CIA justified its use of such techniques with inaccurate claims of their effectiveness, including examples of thwarted plots in Britain.

The US Supreme Court has held since at least the 1890s that punishments that involved torture are forbidden under this the Eighth Amendment. The Eighth Amendment to the US Constitution states: "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted." The 1984 UN Convention against torture that Western states uphold is explicit. It defines torture as "the intentional infliction of severe pain or suffering whether physical or mental." The US only ratified this law 10 years later in 1994, but reigned back on it after 9/11.

Despite US officials describing 9/11 as a clash of civilisations and the ‘war on terror' as a battle to defend liberty. What we witnessed was the abandonment of the very liberty and values into the dustbin of history which the US was purporting to defend. Values were abandoned when it was found difficult to deal or adapt to the new challenges of the international environment. Whilst many in the West argue that in the interest of national security, certain laws can be suspended and are necessary. The rationale of protecting the nation's security is the perennial argument used by dictators and tyrants through the ages and is used constantly by regimes from North Korea to Zimbabwe to defend their draconian policies. However these regimes don't pretend to be something that they are not and nor do they seek to promote their values abroad. It is the active promotion of secular democracy abroad while simultaneously abandoning it at home that is the brazen hypocrisy.

But the suspension of the presumption of innocence, the right to a fair trial, the right to be aware of the evidence that is being used to imprison you and not being tortured, are not mere footnotes of political life to be altered at will; they are rather supposed to be the bedrock of Western political tradition and history. This violation of its very own values was highlighted by the Senate report, which said the programme, which is now defunct, violated American ideals by torturing suspects.

Barack Obama and the rest of the western world have come out condemning the Bush Government, the CIA and categorically termed the interrogation techniques as torture. They are all trying to wash their hands of this. But the reality is an intricate web of airports around the globe, including at least one in Prestwick, Scotland, were used for the illegal transfer of terror suspects to secret CIA jails in countries outside of US territory and legal protection. Many of America's European allies were deeply involved in the CIA programme. Under President Bush, the CIA used a web of European airports and bases for its extraordinary rendition flights, secretly transferring terror suspects across borders for interrogation. Some European states helped the CIA to carry out kidnappings. Others hosted CIA "black sites" -, torture chambers - on their territory. After 9/11 the CIA reached out to its European allies as it embarked on its detention and extraordinary rendition operation. The aim was to place detainees beyond the reach of law. The active participation of dozens of foreign governments made both the renditions and interrogations possible. According to information compiled by Open Society Foundations, at least 54 governments cooperated with these CIA activities. Twenty-one of those are European, of which 17 were at the time members - or soon to become members - of the European Union. The UK cooperated closely with the CIA on detention and rendition - as documents found in Libya after the overthrow of Muammar Gaddafi in 2011 showed. The use of torture was not just routine, but included the willing participation of much of the west.

It is also extremely difficult to take Obama seriously, whilst he may have brought some of Bush's programmes to an end, he has however maintained Guantanamo Bay and expanded the US Drone programme across the globe. Similar to Bush's justification for torture Obama has justified drone strikes as targeted killings and precision strikes based on sound intel. But this has been exposed as what drone strikes really do is signature strikes not precision strikes. This is when the decision to fire is based not on who the targets are but on whether they are exhibiting suspicious patterns of behavior thought to be "signatures" of terrorists. So what's a signature behavior? "The definition is a male between the ages of 20 and 40," former ambassador to Pakistan Cameron Munter told the Daily Beast . The New York Times quoted a senior State Department official as saying that when the CIA sees "three guys doing jumping jacks," the agency thinks it is a terrorist training camp. Obama and Bush are in reality two sides of the same coin.

In defence of its values, the US administration, who is tasked with applying the values it is elected for, abandoned them. The justifications for this was accepted by the US public as a necessary evil in light of the 9/11 attacks. Despite this contradicting the US constitution, the US constitution was abandoned - in the name of defending it - a contradiction of epic proportions. In the face of adversity and a people who did not embrace so called universal values of liberty, democracy and justice, these very values were seen as impractical in this post 9/11 environment. The question that arises form this is if this bedrock of western civilisation is impractical, what does this say of other western values. This brings us to the title of this article - America's Soviet moment.

In 1961 the Soviet Union sought coexistence with the US, the world's leading Capitalist state. This was in direct contravention of the Communist creed. Communism eschewed all coexistence with Capitalism. By replacing the destruction of Capitalism with its accommodation, many people became aware of the impracticality of Communism in regulating relations with other states. This effectively became the beginning of the end of Communism and accelerated its demise, with its eventual collapse in 1990. With the US, dealing with those who do not espouse your values has highlighted a weakness in its values. Along with the Ferguson riots and other recent cases of racism within US institutions, US torture of those who were never afforded a trial may very well be America's Soviet moment and the beginning of the end of Capitalism.

  Oh People! Where is the Officer Who Will Say Not One More Bullet Shall be Allowed to be Fired at the People...? Tyrant Hasina has Resorted to the Use of Iron and Fire to Compel You to Submit to Her Rule; the Only Way to Free Yourselves from Her is

Muhammad (saw) said, «وشِرَارُ أَئِمَّتِكُمْ الَّذِينَ تُبْغِضُونَهُمْ وَيُبْغِضُونَكُمْ وَتَلْعَنُونَهُمْ وَيَلْعَنُونَكُم»

"...The worst of your leaders are those whom you hate and they hate you, and you curse them and they curse you..." [Sahih Muslim]

Isn't the tyrant of this land, Sheikh Hasina from amongst the category of worst rulers, oh people? We hear what is in your hearts and mouths in terms of your rejection of her rule, your hate for her, cursing her and earnestly making du'a to Allah (swt), the Lord of the worlds to free you from her tyranny. She has transgressed in the land arrogantly, causing much suffering for the people on the one hand and shutting their mouths with bullets on the other hand, anyone who tries to expose or speak against the mischief of her government.

((الَّذِينَ طَغَوْا فِي الْبِلاَدِ * فَأَكْثَرُوا فِيهَا الْفَسَادَ))

"Who did transgress beyond bounds in the lands. And made therein much mischief." [Surah Al-Fajr: 11-12]

Hasina began her tenure in the most heinous way by massacring the army officers in Pilkhana at the behest of her foreign masters. Then she embarked on committing acts of treachery against the interests of the country and fulfilling her masters' interests one after another, and thus she continues till today. And her government has been no different to that of Khaleda Zia in terms of looting the people's wealth and failing to take care of the people's affairs. And she increased in that. Moreover, her Godless regime's enmity to Allah, His Messenger (saw) and the Believers is beyond bounds such that it has become the touchstone of her government.

When her mischief and that of her government caused the people to reject her, she resorted to suppression and force by use of iron and fire to compel the people to submit to her rule, abducting and arresting whoever expresses their discontent and firing at any gathering of people, whether it was for making demands or protesting the excesses of the government. "No Demands and No Protests" is her policy. Hasina is fully aware that her rule has no support among the people, so her brutalities increase and the people's blood has become cheap to her, in an attempt to tame the people and humiliate them until they accept that which is implemented upon them.

Oh Muslims!

This is not your fate, to have a ruler like Hasina or her counterpart Khaleda Zia ruling over you is not fate. Muhammad (saw) informed us of better rulers for the Muslims,

«خِيَارُ أَئِمَّتِكُمْ الَّذِينَ تُحِبُّونَهُمْ وَيُحِبُّونَكُمْ وَيُصَلُّونَ عَلَيْكُمْ وَتُصَلُّونَ عَلَيْهِمْ... »

"The best of your leaders are those whom you love and they love you, and you pray for them and they pray for you..." [Sahih Muslim]

And this is not restricted, having rulers like Abu Bakr and Umar (ra), rulers who care for you, who love you and pray for you is not restricted for the Muslims of the times of the Sahabah (ra). The hadith did not state so and specify the information by a time period. Moreover, there are other ahadith which confirm that the Muslims will soon have the second Khilafah "Caliphate" Rashidah state, ruling them with compassion, caring for them, acting as their guardian rather than being an enemy to them like the tyrants of today. And justice will spread in the land for its people, Muslims and non-Muslims alike, provisions will be abundant and the Ummah will have her honour and glory restored.

And the matter will be like this, oh Muslims, if you chose to undertake the right actions for correcting the situation. The first of this is the rejection of the entire kufr ruling regime, hating it and cursing it like your hatred and curse for Hasina. You have to shun every call and every caller to the democratic system and to democratic movement and those who present themselves as an alternative force but within this democratic political set up. It is this rotten democracy which created and made space for the likes of Hasina to enter politics, corrupt it and reach the authority. So even if fresh elections were to take place which was so called free and fair and even if she was voted out of power, you know very well that the one replacing her will be no better and then soon after Hasina herself will return to power, through another election. Stop this circus, oh people, stop putting these corrupt transgressors in authority by your own hands!

Secondly, reject all forms of foreign intervention in your affairs and resist those who are calling for applying foreign pressure and involvement in ensuring fresh elections. The foreign powers' involvement, the involvement of US-Britain-India, their involvement in our affairs is the worst of matters and they have made matters like the way it is today. Are they not the backers of Hasina and Khaleda? Then who other than the shallow and the ignorant or worse still, an agent of the imperialists, disguising himself as an intellectual or a politician would call for this?

Thirdly, undertake the political struggle with Hizb ut Tahrir against Hasina and the Kufr regime. Do not stay silent against the tyrant; otherwise her brutalities will keep increasing. Moreover, accounting the tyrant ruler is an obligation upon you:

عَنْ النَّبِيِّ صلى الله عليه وسلم قَالَ

...كَلَّا وَاللَّهِ لَتَأْمُرُنَّ بِالْمَعْرُوفِ وَلَتَنْهَوُنَّ عَنْ الْمُنْكَرِ وَلَتَأْخُذُنَّ عَلَى يَدَيْ الظَّالِمِ وَلَتَأْطُرُنَّهُ عَلَى الْحَقِّ أَطْرًا وَلَتَقْصُرُنَّهُ عَلَى الْحَقِّ قَصْرًا

"Nay, by Allah, you have to enjoin the good and forbid the evil and hold the hand of the tyrant and force him on the truth and restrict him to the truth." [Abu Dawud and Tirmidhi]

Finally and most importantly, call upon the sincere officers in the military to perform their duty towards Islam and the people by overthrowing Sheikh Hasina. Your fathers, brothers, sons, nephews, friends and known ones from amongst the officers, all of them, owe a duty to Allah, His Messenger and the People. So demand from them to fulfill their duty, they are the ones who have the material power to remove Hasina and the ruling regime. Making the sincere officers to switch sides, making them abandon the regime and to take the people's side is the assured way to change the regime when they overthrow it, not for taking power for themselves, rather for transferring the authority to sincere and aware politicians, those politicians who will build the regime on a new basis, the Islamic basis and declare Bangladesh as the Khilafah "Caliphate". These sincere and aware politicians, those who are aware of how to solve the people's problems according to the Qur'an and the Sunnah, how to industrialize the country, how to face regional and global challenges, are to be found in Hizb ut Tahrir and not in any other party, the combination of the two - sincerity and deep awareness - does not exist in any other party. Indeed, you have in Hizb ut Tahrir, its leader Sheikh Ata Bin Khalil Abu Al-Rashtah and its members, aware politicians who sincerely care for you, love you, pray for you and cry to Allah (swt) in their du'as to bestow upon you all the good in the Dunya and in the Akhira.

So demand from the officers whom you know and you meet that they overthrow Sheikh Hasina and transfer the authority to Hizb ut Tahrir to establish the Khilafah "Caliphate". And may be Allah (swt) will honour you and honour them in the Dunya and the Akhirah due to this noble deed of yours, if you did it, insha'Allah, in the same way He (swt) honoured the Ansar (ra) who provided material support to RasulAllah (saw) to establish the Islamic rule in Madina and their families.

Oh Sincere Officers, the People of Power!

The return of the Khilafah "Caliphate" is an inevitable matter, it is from the decreed matters of Allah (swt) and it will be soon, insha'Allah. But it will not fall from the sky. So the question is not is it possible for the Khilafah "Caliphate" to be re-established, rather the question is by whose hand Allah (swt) will cause it to return and accordingly He (swt) honours them. Who from you seeks this honour; who from you wants to become the means for the return of Islam in ruling and the liberation of the people from this tyranny? Who from you has the courage, which an officer is supposed to have, to be the supporters of Islam and the people? We are aware that the regime is indoctrinating you with the motto of "safeguarding the constitution" and other such nonsense which mean nothing but being loyal to Hasina and the regime. But what about your loyalty to Allah (swt), His Messenger and the People? What about the blood of the people, is there not among you an officer or officers who will say not one more bullet shall be allowed to be fired at the people by tyrant Hasina and her henchmen? Oh officers! Respond and do not delay; respond to the command of Allah (swt) and His Messenger (saw) and respond to the call of the people. Be the vehicle for the fulfillment of Allah's promise; overthrow Sheikh Hasina and transfer the authority to Hizb ut Tahrir to establish the Khilafah "Caliphate". May be He (swt) will honour you and your families in the Dunya and the Akhira like He (swt) honoured the Ansar (ra) and their families.

وَعَدَ اللَّهُ الَّذِينَ آمَنُوا مِنْكُمْ وَعَمِلُوا الصَّالِحَاتِ لَيَسْتَخْلِفَنَّهُم فِي الأَرْضِ كَمَا اسْتَخْلَفَ الَّذِينَ مِنْ قَبْلِهِمْ وَلَيُمَكِّنَنَّ لَهُمْ دِينَهُمُ الَّذِي ارْتَضَى لَهُمْ وَلَيُبَدِّلَنَّهُمْ مِنْ بَعْدِ خَوْفِهِمْ أَمْنًا يَعْبُدُونَنِي لاَ يُشْرِكُونَ بِي شَيْئًا وَمَنْ كَفَرَ بَعْدَ ذَلِكَ فَأُوْلَئِكَ هُمْ الْفَاسِقُون

"Allah has promised those among you who believe and do righteous good deeds, that He will certainly grant them succession (to the present rulers) in the land, as He granted it to those before them, and that He will grant them the authority to practice their Deen which He has chosen for them. And He will surely give them in exchange a safe security after their fear (provided) they (believers) worship Me and do not associate anything (in worship) with Me. But whoever disbelieved after this, they are the Fasiqun." [Surah An-Nur: 55]

German Eurosceptics Embrace Anti-Islam Protests

The wave of anti-Islam protests gripping the German city of Dresden have ignited a political row, after the leader of the country's rapidly growing Eurosceptic party publicly backed the protesters. Ten thousand people took to the streets of Dresden on Monday in the latest in a series of weekly rallies under the banner of Patriotic Europeans against the Islamisation of Europe, or Pegida, to protest against what they say is the erosion of Germany's Judeo-Christian culture by Muslim immigrants. Bernd Lucke, the leader of the anti-Euro Alternative for Germany party (AfD), provoked outrage when he backed the protesters on his Facebook page, saying it is "good and right" that people are giving voice to their fears. "It is a sign that these people do not feel their concerns are understood by politicians," he wrote. The AfD, which opposes the single currency and further integration, but is not against the EU, has made considerable gains in recent state elections. [Source: The Independent]

The harbingers of freedom and democracy are again showing their true colors towards Islam. Yet despite all the vitriol and hatred, the leaders of the Muslim world are unable to highlight the inconsistencies in West's secular ideology and its stance on tolerance. On the contrary, the rulers go out of their way to endorse West's bigotry by turning a blind eye to the treatment of Muslims in the West.

CIA Interrogations Report Sparks Prosecution Calls

The UN and human rights groups have called for the prosecution of US officials involved in what a Senate report called the "brutal" CIA interrogation of al-Qaeda suspects.  A top UN human rights envoy said there had been a "clear policy orchestrated at a high level". The CIA has defended its actions in the years after the 9/11 attacks on the US, saying they saved lives. President Barack Obama said it was now time to move on. The summary of a larger classified report says that the CIA carried out "brutal" interrogations of al-Qaeda suspects in the years after the 9/11 attacks on the US and misled other officials about what it was doing.  The information the CIA collected this way failed to secure information that foiled any threats, the report said. UN Special Rapporteur on Human Rights and Counter-Terrorism Ben Emmerson said that senior officials from the administration of George W Bush who planned and sanctioned crimes must be prosecuted, as well as CIA and US government officials responsible for torture such as waterboarding. "As a matter of international law, the US is legally obliged to bring those responsible to justice," Mr Emmerson said in a statement made from Geneva. "The US attorney general is under a legal duty to bring criminal charges against those responsible." [Source: BBC News]

Yet again, the world is seeing what it already knew that America only pays lip service to human rights. And what is the point of revealing such information if there is no prosecution of Bush, Cheney and others who instigated such practices. Unlike Western liberalism which changes its definition of human rights and torture to safeguard the interest of Western governments, Islam is clear about torture. Hisham said: I heard the Messenger of Allah (saw), say:

«إِنَّ اللَّهَ يُعَذِّبُ الَّذِينَ يُعَذِّبُونَ النَّاسَ فِي الدُّنْيَا»

"Verily, Allah will torture those who torture people in this world." (Source: Sahih Muslim 2613)

Egypt: ‘Revolution Insult' Law Raises Concerns

A law, being drafted by the Egyptian government to penalise critics of the country's recent popular uprisings, threatens to muzzle political dissent, rights advocates and political experts have warned. President Abdul Fattah Al Sissi said the law will be issued soon, criminalising what he called "insulting" the revolts that toppled long-time president Hosni Mubarak in 2011 and his successor Islamist Mohammad Mursi two years later. The law is seen as mainly designed to placate disenchanted backers of the anti-Mubarak revolt largely branded in pro-Al Sissi media as a foreign conspiracy. Specific penalties in the disputed law are not clear yet. The mere talk about incriminating insult to any revolution constitutes suppression of freedom and rights," Najad Al Buraei, a rights campaigner, said. "Stipulations of this law will be vague because it is difficult to set rules for criminalising a certain opinion. Such a law will be used to restrict freedoms," he added. Thousands of activists, mainly Islamists, have been detained and put on trial since last year when the army, led at the time by Al Sissi, deposed Mursi following enormous street protests against his one-year rule.  Mursi's Muslim Brotherhood has denounced his removal as a military coup and vowed to reinstate him despite a draconian security crackdown. Meanwhile, dozens of pro-democracy secularists, who mobilised the uprising that eventually forced Mubarak to step down, have been jailed for holding illegal protests amid a ferocious media campaign accusing them of being foreign agents. Staunch backers of Al Sissi like ex-lawmaker Mustafa Bakri is critical of the planned bill. "This law will mark a serious turning point in the course of freedom. It will place restrictions on historians who seek to evaluate this period," Bakri said in a Facebook post. "I hope that President Al Sissi whom I trust as a defender of freedom and the truth will stop the issuance of this law." All those who thought Sisi would be better than Morsi for Egypt must now think that Sisi is worse than Mubarak. After releasing the tyrant Mubarak, Sisi is slowly moving towards using legislation to punish anyone that contemplates fomenting a revolution in the future. The only hope for Egyptians yearning for liberations from tyranny is in the re-establishment of the Khilafah "Caliphate". It is only through the Khilafah "Caliphate" State that Egyptians can be safe from the likes of Mubarak and Sisi.
