titled: “Presentation of the Draft Constitution that Resolves Dispute, Brings Parties together, and Infuriates the Enemies”
(Translated)

In the Name of Allah—the Most Compassionate, Most Merciful. And prayers and peace be upon the envoy as a mercy to the worlds, our master and beloved Muhammad (saw), the guide to the Straight Path, and his honorable family and companions, and whoever follows his path and traces his footsteps until the Day of Judgment.

Honorable Attendees, Assalamu Alaikum wa Rahmatullah wa Barakatahu,

Referring to what is going on in the political arena in Sudan, in terms of attempts to resolve the crisis of governance; this chronic crisis that flayed our country for decades, while it was languishing under its chains, as the political forces remained, throughout these decades, captive to what the colonialists planned in terms of systems of government, politics, economics, and others.

Today, honorable attendees, followers, and viewers, we stand with you in front of a unique case of principled thinking outside the box of the distressed reality in diagnosing the problem in depth, and seeking principled solutions to the crisis of governance and the constitutional void that our country is experiencing.

We, in Hizb ut Tahrir / Wilayah of Sudan, present to everyone concerned with the interest of the country and the people, the draft constitution of the Khilafah (Caliphate) State of 191 articles, which contains general provisions, the system of government, the economic system, the social system, education policy, and foreign policy, through the general framework and the following details:

First: As Muslims, the basis of the draft constitution, which is the basic law of the state, must be based on the faith of the Ummah; the great doctrine of Islam.

Therefore, the first article of the draft constitution of the Khilafah State says that “the Islamic belief is the basis of the state, so that nothing can exist in its entity, apparatus, accountability or everything related to it, except by making the Islamic belief its basis.”

Secondly: The provisions of this constitution are derived with right ijtihad from the Book of Allah and the Sunnah of His Messenger (saw), and what they guided to in terms of the consensus of the companions, and the Sharia’a measurement, that is, they are Sharia’a provisions, and not man’s opinions, as is the case in the proposed constitutions without exception.

Third: The draft constitution of the Khilafah State raises the ongoing dispute with the provisions of the Holy Revelation, as:

A) The authority is for the Ummah, as it chooses a man within it who completes the conditions for the contract of the Khilafah, and pledges allegiance to him as Khalifah (caliph) for the Muslims, and as the Amir of the believers in whom Allah’s righteous law applies among them.

B) Muslims have the right to establish political parties to hold rulers accountable, or to reach power through the Ummah, on the condition that their basis is the Islamic faith. It is the one that holds the ruler accountable on the basis of Islam if he deviates from the path or fails to take care of affairs. The right of accountability is not exclusive to political parties, but to the subjects as well. This is what Islam guarantees to everyone.

C) The task of the army is to perform jihad in the way of Allah, and to protect the spawn of Islam and the frontiers of Muslims, and it has nothing to do with governance as it is an armed force. Rather, it is its right to pledge allegiance to the Khalifah of the Muslims, considering its members as subjects of the state. The Military Department handles all affairs related to the armed forces, including the army, police, equipment, missions, equipment, and the like. This department is a part of the state, and its leader is called the Amir of Jihad. The Muslim army is one army, no matter how many divisions it has, and it is under the leadership of the Khalifah.

Fourth: The draft constitution of the Khilafah brings the parties together with the following provisions:

A- It will not allow any influence of the colonial kufr (infidel) in our country, as is the case today, because Allah Almighty forbade us to give the kufr a power over the Muslims, and the Almighty said:

(وَلَنْ يَجْعَلَ اللَّهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلاً) “And Allah will never grant the disbelievers a way over the believers.” [An-Nisa 4:141]. And He said:

(لَا يَتَّخِذِ الْمُؤْمِنُونَ الْكَافِرِينَ أَوْلِيَاءَ) “Believers should not take disbelievers as guardians” [Aali’Imran 3:28].

B- The foreign policy in the Islamic state is centered on carrying the Islamic Dawa’a, and countries are treated accordingly. Therefore, the truly colonial countries such as America, Britain, and France, and the greedy countries in our country, such as Russia, are considered belligerent countries, so all precautions must be taken with regard to them, and it is not allowed to establish any diplomatic relations with them. It is also not permissible for any individual, party, bloc, or group to have a relationship with any of the foreign countries at all, and the relationship with countries is limited to the state alone.

Fifth: The resumption of Islamic life, by establishing the second Rightly Guided Khalifah on the method of the Prophethood, whose draft constitution establishes a real renaissance on the basis of Islam, irritates the enemies, because it takes the initiative and leads the world from them as it was when the Islamic Ummah had a Khalifah (Caliphate) based on the provisions of Islam, so it liberated the world from the oppression of the false religions, and surrounded them with the justice and mercy of Islam, and brought the worlds out of the narrowness of this world to the spaciousness of this world and the hereafter, so the best Ummah brought out to people returns as the Lord of Glory wanted for us. Allah says:

(كُنْتُمْ خَيْرَ أُمَّةٍ أُخْرِجَتْ لِلنَّاسِ تَأْمُرُونَ بِالْمَعْرُوفِ وَتَنْهَوْنَ عَنِ الْمُنْكَرِ وَتُؤْمِنُونَ بِاللَّهِ)

“You are the best community ever raised for humanity—you encourage good, forbid evil, and believe in Allah.” [Ali’Imran 3:110]

In conclusion: We present the draft constitution of the Khilafah State to the entire Ummah, to the Ummah's leaders and dignitaries, politicians, and thinkers, to study it, adopt its ideas, and put it into practice and implementation, so that Allah may bless us with His mercy and blessings. And from the soldiers who are loyal to their faith and Ummah, Hizb ut Tahrir requests that the authority be handed over to it in order to put in place this constitution and the entire system of legislation and regulations that the party has adopted from the great Islam, to put them into practice and implementation.

(هَذَا بَلَاغٌ لِلنَّاسِ وَلِيُنْذَرُوا بِهِ وَلِيَعْلَمُوا أَنَّمَا هُوَ إِلَهٌ وَاحِدٌ وَلِيَذَّكَّرَ أُولُو الْأَلْبَابِ)

“This ˹Quran˺ is a ˹sufficient˺ message for humanity so that they may take it as a warning and know that there is only One God, and so that people of reason may be mindful.” [Ibrahim: 14:52]
